AMENDMENT #4
In accordance with the provisions to KRS 350.070,
notice is hereby given that Leeco, Inc., 1374 Hwy
192 East, London, KY 40741 has applied for an
amendment to an existing surface coal mining
and reclamation operation located .5 miles north
of Carcassonne in Letcher and Knott counties.
The amendment will add 32.82 acres of surface
disturbance making a total of 756.17 acres within
the amended permit boundary.
The proposed amendment area is approximately
4 miles southwest from Route 15’s junction with
Defeated Creek Road and located on Bull Creek.
The proposed amendment is located on the
Blackey and Vicco U.S.G.S. 7 ½ minute quadrangle
maps. The surface area to be disturbed
by the amendment is owned by Leeco, Inc. The
operation will use the contour, auger and area
mining methods. The operation will affect an
area within 100 feet of public road KY 3408. The
operation will not involve relocation or closure of
the public road.

Amendment No. 1
In accordance with KRS 350.070, notice is hereby
given that Cumberland River Coal Company, P.
O. Drawer 109, Appalachia, Virginia 24216 has
applied for an amendment to an existing underground
coal mining and reclamation operation
located approximately 2 miles east of Eolia in
Letcher County. The amendment will add 2.5
acres of surface disturbance and will underlie
an additional 3,726.58 acres making a total area
of 3,783.28 acres within the amended permit
boundary.
The proposed amendment area is approximately
1 mile southeast from the Meadow Branch Road
junction with State Route 932 and located 0.25
miles south of Meadow Branch.
The proposed operation is located on the Flat
Gap and Whitesburg U.S.G.S. 7-1/2 minute quadrangle
maps. The surface area to be disturbed by
the amendment is owned by ACIN, LLC. The
amendment will underlie land owned by Ark Land,
ACIN, LLC, Minnie Trivett Heirs, Carter/Sturgill,
Authur Sturgill, Mario Ravet, Harlos Phillips, Ida
Stidham, RJD &D Enterprises, Isom Smith, Sam
Maggard, James Maggard, Carl Church, Oliver

LLC, 5703 Crutchfield Drive, Norton, Virginia,
24273 has applied for an amendment to an
existing underground coal mining and reclamation
operation located 1.86 miles southwest
of Redfox in Knott and Letcher Counties. The
amendment will add no additional surface acres
and will underlie an additional 1129.74 acres
making a total area of 7028.09 acres within the
amended permit boundary.
The proposed amendment area is approximately
5.0 miles northwest of the intersection of KY
7’s junction with KY 15 and located on L. Smith
Branch.
The proposed amendment is located on the
Blackey and Vicco 7-1/2 minute quadrangle
maps. The amendment will underlie land owned
by Kentucky River Coal Corporation, Dorothy &
Wheeler Brown, Crawford Engineering, Martha
Back Heirs, Estill Jent, Kodak Mining Company,

BOND RELEASE
Pursuant to Application Number 867-5168
In accordance with the provisions of KRS
350.093, notice is hereby given that Premier
Elkhorn Coal Company, P.O. Box 130, Myra,
Kentucky 41549, has applied for a Phase III
bond release of permit number 867-5168 for
increments 1, 3, and 4, a Phase II bond release
of permit number 867-5168 for increment 2, and
a Phase I & II bond release of permit number
867-5168 for increment 5, which was last issued
on 12/08/2006.
The application covers an area of approximately
478.18 acres located one and two tenths
(1.2) miles north of Jenkins in Letcher County.
The proposed operation is approximately 1.6
miles northwest from US 23/119’s junction with
Joe’s Branch Road and located 0.2 miles west
of Joe’s Branch. The latitude is 37° 12’ 20”.
The longitude is 82° 37’ 53”.
The bond now in effect for increment 1 is a
surety bond for eight thousand, nine hundred
dollars ($8,900). Approximately 15 percent
(15%) of the original bond amount of ($8,900)
is included in this application for release.
The bond now in effect for increment 2 is a
surety bond for seventeen thousand, eight
hundred dollars ($17,800). Approximately 25
percent (25%) of the original bond amount of
($18,300) is included in this application for
release.
The bond now in effect for increment 3 is a
surety bond for six hundred dollars ($600).
Approximately 15 percent (15%) of the original
bond amount of ($20,000) is included in this
application for release.
The bond now in effect for increment 4 is a
surety bond for three thousand, eight hundred
dollars ($3,800). Approximately 15 percent
(15%) of the original bond amount of ($5,000)
is included in this application for release.
The bond now in effect for increment 5 is a
surety bond for twenty one thousand, one
hundred dollars ($21,100). Approximately 85
percent (85%) of the original bond amount of

Phase I reclamation work performed includes:
backfilling, final grading, seeding, and mulching.
Phase I reclamation work was completed
in the spring of 2003. Phase II reclamation
work performed includes tree planting. Phase
II reclamation work was completed in the spring
of 2005.

a public or informal conference must be filed
with the Director, Division of Mine Reclamation
and Enforcement, #2 Hudson Hollow, Frankfort,
Kentucky 40601, by September 3, 2009.
A public hearing on the application has been
scheduled for September 4, 2009 at 9:00 am at
the Division of Mine Reclamation and Enforcement’s
Pikeville Regional Office located at 121

The hearing will be canceled if no request for a
hearing or informal conference is received by
September 3, 2009.

ORDINANCE 218
REVISING CHAPTER 110, THE CITY LICENSE TAX
WHEREAS, the City finds that it has not revised its City
License Tax in over 25 years, and
WHEREAS, the City finds that its occupational categories
are antiquated and in some cases obsolete, and
WHEREAS, the City finds and many of the dollar
amount differences between occupations no longer
have a rational basis, and
WHEREAS, the City desires to modernize its business
categories and provide a more unified system of
assessment that would be both fair to its citizens and
serves the needs of the City.
NOW THEREFORE, the City Council of the City of Jenkins,
Letcher County, Kentucky does hereby modify,
restate and add provisions to Chapter 110 City License
Tax as follows:

There is further created the following new sections:
§110.13 All other occupations or businesses not categorized
will be $50.00.
§110.14 Should a particular person, firm or corporation
engage in business or commerce which might fit
more than one particular category, then the city license
tax shall be only one assessment which would be for
the amount charged for the highest category within the
combination of categories possible.
§110.15 In addition to the penalties set out in §110.99
below, the City may enforce the collection of the license
tax under this section, including any fees, penalties and
interest as provided in the delinquent ad valorem tax
section by civil action in the court of appropriate jurisdiction.
To the extent allowed by law, the City shall be
entitled to recover all its costs and reasonable attorney
fees incurred by it in enforcing or collecting from any
provisions of this Ordinance.
THEREFORE, the City Council of the City of Jenkins
having voted and passed this Ordinance, it shall become
effective upon publication as required by Law.

NOTICE TO PUBLIC
OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

The Letcher County Fiscal Court

TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:
On or about April 15, 2010, the above Letcher County Fiscal Court will finalize the Environmental Review for the
following project:
Pioneer Horse Trail Project
This project will construct approximately 15 miles of loop trail for equestrian traffic along
and adjacent to the ridge line of Pine Mountain in Letcher County.
Census Tracts 950400 and 950500
The County will also request the Kentucky Department of Fish and Wildlife for permission to proceed with trail development.
It has been determined that such request will not constitute an action significantly affecting the quality of
human environment and, accordingly, the above named county has decided not to prepare an Environmental Impact
Statement under the National Environmental Policy Act of 1969 (PL-91-190).
The reasons for the decision not to prepare an Impact Statement are as follows:
Upon review of the project it was determined that no significant impact on any aspect of the environment would occur
as a result of the completion of this project.
An Environmental Review Record respecting the within project has been made by the above named Letcher County
Fiscal Court which documents the methods and process used in the completion of the environmental review of the
project and more fully sets forth the reasons why such statement is not required. This Environmental Review Record
is on file at the above address and is available for public examination and copying, upon request, in the County Judge
Executive’s office between the hours of 8:00 AM and 4:00 PM, Monday through Friday. No further environmental
review of this project is proposed to be conducted prior to the request for permission to proceed.
All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for
consideration to the Office of the Judge Executive at the above address. Such written comments should be received
no later than 4:00 PM on April 12th, 2010. All such comments so received will be considered and the Letcher County
Fiscal Court will not request permission to proceed or take any administrative action on the above project prior to the
date specified on the proceeding sentence.
The Letcher County Fiscal Court will undertake the project described above with county and state funds.
The Fiscal Court is certifying to the state that the Fiscal Court and Jim Ward, in his official capacity as County Judge
Executive consent to accept the jurisdiction of the state courts if an action is brought to enforce responsibilities in
relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied.
The legal effect of the certification is that upon its approval the Fiscal Court will have satisfied their responsibilities
under the National Environmental Policy Act of 1969. The state will accept an objection to its approval only if it is
on one of the following bases:
(a) The certification was not in fact executed by the county’s Certifying Officer.
(b) The county has to make one of the two findings pursuant to S58.41 or to make the written determination decision
required by SS578.57, 58.53 or 58.64 for the project, as applicable.
(c) The county has omitted one or more of the steps set forth at Subparts F and G for the preparation and completion
of an EA.
(d) No opportunity was given to the Advisory Council on Historic Preservation or its Executive Director to review the
effect of the project on a property listed on the National Register of Historic Places, or found to be eligible for such
listing by the Secretary of the Interior, in accordance with 36 CFR Part 800.
(e) Objections have been made by a federal agency.
Objections must be prepared and submitted in accordance with the required procedures (40 CFR Part 1500-1517)
and may be addressed to the Kentucky Department of Fish and Wildlife Services, #1 Sportsman’s Lane, Frankfort,
Kentucky 40601. Objections to the environmental release on bases other than those stated above will not be considered
by the state. No objection received after April 12, 2010 will be considered by the state.
