Grand jury indicts 29
Twenty-four people are named in 29 indictments returned last week by the Letcher Grand Jury. Those named in the indictments handed up January 10 to Letcher Circuit Judge Sam Wright and the charges against them are:
• Mary Ann Fugate - first-degree promoting contraband and being a persistent felony offender.
The grand jury charged Fugate, 42, of 497 Great Oak Road, Mayking, with possessing a quantity of hydrocodone on November 9, 2007 while being an inmate in the Letcher County Jail. Fugate was also charged with being a persistent felony offender after having been previously convicted of a felony.
The case was presented to the grand jury by Letcher County Deputy Jailer Donna Slone.
In a second indictment, Fugate was charged with first-degree trafficking in a controlled substance when she allegedly sold a quantity of prescription medication found to contain Oxycodone, a Schedule II narcotic drug, to a cooperating witness of the Letcher County Sheriff's Department on September 17, 2007. She is also charged with being a persistent felony offender.
Lieutenant M.K. Terry of the Letcher County Sheriff's Department testified in the case.
• Ricky Allen Bates Sr. - second degree assault and being a persistent felony offender.
The grand jury returned an indictment charging Bates, 43, of 65 #1 Bottom, Jenkins with "wantonly causing physical injury to Martha D. Bates by means of a deadly weapon or dangerous instrument when he struck her in the head with a skillet and repeatedly stomped her, causing lacerations to her head and feet." The incident allegedly occurred on September 12, 2007.
Bates was also charged with being a persistent felony offender.
Kentucky State Police Trooper Derek Hall testified in the case.
• Chris Wayne Johnson - first-degree burglary and theft by unlawful taking.
Johnson, 20, of 66 Ginseng Drive, Jenkins, is accused of entering the residence of Wesley Fleming at 157 Brick Street, Jenkins for purpose of committing theft of property.
He is also charged with taking a 9mm Hi-Point firearm owned by Fleming.
The grand jury heard testimony in the case from Jenkins Police Officer Anthony Maggard.
• Lisa Halcomb - first-degree criminal possession of a controlled substance and use or possession of drug paraphernalia.
The grand jury charged Halcomb, 39, of Colliers Creek, Whitesburg, with possessing four Fentanyl patches, which is a Schedule II narcotic, on June 14, 2007.
The grand jury heard testimony in the case from Scott Bailey, with Operation UNITE (Unlawful Narcotics Investigations, Treatment and Education).
• Samuel E. Adkins, II and Gregory A. Hall - first-degree burglary, criminal possession of a firearm by a convicted felon and theft by unlawful taking (more than $300).
Adkins, 31, of 66 Cove Street, Jenkins and Hall, 26, of 556 Mountain Breeze Road, Jenkins, are charged with unlawfully entering the residence of Samuel Adkins, Sr. and allegedly being armed with a semi automatic pistol belonging to Adkins on October 28, 2007.
Adkins and Hall are also charged with theft by unlawful taking of "various items of jewelry and other personal property valued at $300 or more from the residence of Samuel Adkins Sr."
Adkins is charged with being a persistent felony offender.
In separate indictments, Adkins and Hall are charged with second-degree possession of a forged instrument.
The second indictments for Adkins and Hall say they "possessed a check from the residence of Samuel Adkins, Sr. which had been forged as if drawn by the holder of the account, Samuel Adkins Sr., all an attempt to cash said check."
Jenkins Police Sergeant Adam Swindall testified in the case.
• Clarence E. Yeary II - second degree possession of a forged instrument and being a persistent felony offender.
Yeary, 29, of 228 Store Hill, Jenkins, is accused of trying to cash a check belonging to Samuel Adkins Sr. on October 28 or 29.
Jenkins Police Sergeant Adam Swindall testified in the case.
• Crystal Brooke Wagner - receiving stolen property (more than $300).
The grand jury returned an indictment charging Wagner, 23, of 66 Cove Street, Jenkins, with "selling one gold chain, two lady's bracelets, one lady's ring, one men's .75 carat ring and one lady's necklace, knowing or having reason to know that all of the above property was stolen when she sold the items of jewelry valued at $300 or more to Castle's Jewelry." The incident happened on October 28 or 29.

• Brandon Stanley - operating a motor vehicle while under the influence of drugs, operating or being in control of an automobile while having his operator's license suspended, and two counts of first-degree wanton endangerment.
The grand jury accuses Stanley, 21, of 791 McPeeks Branch, Jenkins, of "operating a motor vehicle under the influence of drugs so as to impair his ability to operate and control his vehicle." The indictment says this is Stanley's fifth offense within two years.
Stanley was charged with two counts of wanton endangerment for allegedly operating a motor vehicle at an excessive rate of speed through a residential neighborhood with two passengers inside the vehicle on October 27, 2007.
The grand jury heard testimony in this case from Jenkins Police Sergeant Adam Swindall.
• George Roy Logan and Joshua R. Logan - complicity to third-degree burglary and complicity to theft.
George Logan, 48, and Joshua Logan, 22, both of 8939 Highway 160, Whitesburg, are accused of "entering the John Ison Store at Linefork for the purpose of stealing cash from the cash register" on May 27, 2007.
George Logan and Joshua Logan are also charged with "unlawful taking of $2,000 in cash from the money drawer."
George Logan is charged with being a persistent felony offender.

• Michael Wayne Slone and Andy Bailey - complicity to third-degree burglary, complicity to theft and two counts of complicity to theft by deception.
According to an indictment, Slone, 31, of 630 Hales Branch, Kite, and Bailey, 36, of Croucher's Apartments, Isom, are charged with entering a storage building for the purpose of stealing two chains saws owned by Teounsel Haynes that are valued at more than $300.
Slone and Bailey allegedly represented to Daniel Eldridge and Jeff Potter that they were the owners of the chain saws and sold the chain saws for less than $300 each.

• Phillip Eugene White - complicity to first-degree burglary, complicity to theft of a firearm and complicity to theft of property valued at $300 or more.
White, 32, of 301 Helton Street, Cumberland, is accused of "attempting to aid Lee Edward Early Jr. in planning or committing said burglary whereby he and/or his co-defendant unlawfully entered the residence of Otis and Grady Bradley with the intent to commit theft while being armed with a firearm, namely a pistol."
White is charged with taking a Colt 45 Caliber Pistol owned by Otis Bradley on June 6, 2007. White is also charged with taking cash, jewelry and other personal property valued well in excess of $300, which was owned by Otis and Grady Bradley.
Letcher County Sheriff 's Deputy Mike Rose testified in the case.
• Can Gibson - two indictments each charging Gibson with one count of trafficking a controlled substance in the second degree.
Gibson, 37, of Yont Fork Road, Neon, is charged with trafficking in a controlled substance in the second degree when Gibson sold a quantity of prescription medication found to contain hydrocodone, a Schedule II controlled substance to Detective Scott Bailey from Operation UNITE on October 30, 2007.
Gibson is also charged with selling a quantity of hydrocodone to a cooperating witness from Operation UNITE on October 31, 2007.
Bailey testified before the grand jury.
• James H. Freeman, also known as "Jimmy John Freeman" - flagrant non support.
The grand jury returned an indictment charging Freeman, 34, of Highway 931 South, Whitesburg, with "failing to provide the support that he reasonably could for his minor child" in the amount of $6,056 for the period ending November 15, 2007.
The grand jury heard testimony from Amy Gosnell, with the Letcher County Child Support Enforcement Office.
• Charles Anthony Hubbard - flagrant non support.
Hubbard, 37, of 1523 Highway 119 North, Ermine, is accused of owing $10,591.76 in child support payments.
Amy Gosnell, with the Letcher County Child Support Enforcement Office, testified in the case.
• John E. Childers - flagrant non support.
Childers, age not given, of 849 Danner Drive, West Jefferson, Ohio, is charged with owing $17,711.43 in child support payments.

• Michael Ray Sergent - trafficking in a controlled substance in the second degree.
Sergent, 31, of Partridge, is charged by the grand jury with selling a quantity of prescription medication found to contain hydrocodone, a Schedule II controlled substance, to a cooperating witness on January 30, 2007.

• Junior Halcomb - trafficking in a controlled substance in the second degree.
Halcomb, 54, of HC67, Partridge, is accused of selling a quantity of prescription medication found to contain hydrocodone, a Schedule II controlled substance, to a cooperating witness on January 29, 2007.
The grand jury heard testimony from Scott Bailey with Operation UNITE.
• Marcus Richardson - two indictments charging him with two counts of trafficking in a controlled substance in the first degree and one count of trafficking a controlled substance in the second degree.
The grand jury charged Richardson, 39, with selling a quantity of prescription medication found to contain Oxycodone, a Schedule II narcotic drug, to a cooperating witness of Operation UNITE on November 2, 2006.
He is also charged with selling hydrocodone and Oxycodone to a cooperating witness of Operation UNITE on October 31, 2006.

• Paula K. Sexton - two counts of trafficking in a controlled substance in the second degree.
The grand jury returned an indictment charging Sexton, 43, of Highway 3074, McRoberts, with selling hydrocodone to a cooperating witness on October 30, 2006.
The grand jury heard testimony from Scott Bailey with Operation UNITE.
• John Paul "Dewey" Wells and Lettie Renae Sexton - complicity to receiving stolen property (more than $300).
Wells, 26, and Sexton, 36, both of 4777 Thornton Road, Thornton, are charged with possessing and selling numerous items of furniture and other household furnishings on August 15, 2007 which were recently stolen from the residence of Bonnie Holbrook valued well in excess of $300. These were represented by the defendants as being the household furnishings left to Lettie Hall Sexton by her deceased grandfather and which were then sold for less than their value to Eddie Profitt.
