Couple indicted in son’s death

McRoberts man and woman among 13 indicted by grand jury


A McRoberts couple have been indicted on charges of second-degree manslaughter in connection with the April drowning death of their 17-month-old son.

The charges against Curtis Wayne Anderson II, 24, and Melissa Gail Anderson, 30, are contained in two of 13 indictments returned by the Letcher County Grand Jury on June 26.

The indictments against the Andersons charge that they were in violation of a temporary custody order when Curtis Wayne Nicholas “Nicky” Anderson III drowned after being left unsupervised while playing near a creek in Jenkins on April 9.

Authorities say the death of Nicky Anderson occurred after he had been left alone to play on a child eventually wandered to the creek and fell in.

The grand jury voted to return the indictments after hearing testimony from Kentucky State Police Detective Randy Combs and Georgia Kincer, a social worker with the Cabinet for Families and Children. More charges are expected to be filed as the investigation continues.

Curtis and Melissa Anderson were being held Tuesday in the Letcher County Jail. Bond for each was set at $25,000 cash.

The grand jury also indicted 11 other people last week, including a man and a woman who are charged with attempting to intimidate witnesses.

In separate indictments, the grand jury says Jason Todd Hall, 30, and Melissa L. Hall, 43, both of 331 E. Potters Road, Neon, acted in complicity in threatening Cole Bentley and members of his household on March 19, 2008 in an attempt to cause them to withhold or alter testimony against Jason Allen Hall in an investigation by the Letcher County Sheriff’s Department. Jason Todd Hall is also charged with being a persistent felony offender.

Letcher County Sheriff’s Lt. Marcus K. Terry testified in the cases.

Others indicted are:

• Jason Allen Todd – receiving stolen property valued over $300.

Todd, 19, of 331 E. Potters Road, Neon, is charged with receiving a pressure washer and a circular saw on January 19, 2008 which he knew were a portion of the property recently stolen from the residence of Mike and Nanette Dingus.

Letcher County Sheriff’s Lt. Marcus K. Terry testified in the case.

• Melissa Renae Fisher – operating an automobile while under the influence of alcohol/ drugs, operating an automobile while having a suspended driver’s license, assault, wanton endangerment.

The grand jury says Fisher, 28, of 2404 Indian Creek Road, Virgie, operated an automobile under the influence of alcohol/ drugs while having a suspended driver’s license on April 19, 2008 and intentionally or wantonly caused injury to Julia Thacker by running her down and striking her with the car. She is also charged with attempting to run down Julia Thacker and Jamie Brown with an automobile.

Jenkins Police Officer Chris Nickels testified in the case.

• Michael Chris Rudd – burglary, taking property valued under $300, and criminal mischief.

The grand jury says Rudd, 31, of 75 Thornton Road, Whitesburg, entered the residence of Ricky Vance on January 21, 2008, and stole a chain and stomach medication. He is also charged with breaking the lock on the main entrance door to Ricky Vance’s residence.

Letcher County Sheriff ‘s Deputy Mike Rose testified in the case.

• Johnny Coomer – assault.

Coomer, 51, of 223 Harrison Br., Isom, is charged with causing serious injury to Wendell McClain by striking him in the head with a metal car jack on June 22, 2008.

Kentucky State Trooper Randy Surber testified in the case.

• Michael North – flagrant non-support.

North, 40, of 1841 Big Branch Rd., Viper, is charged with failing to provide support for his minor child(ren). The grand jury says he owed $8,785.63 through June 12, 2008.

Amy Gosnell of the Letcher County Division of Child Support Enforcement testified in the case.

• David Elkins – flagrant non-support.

Elkins, 42, of Cromona, is charged with failing to provide support for his minor child(ren). The grand jury says he owed $9,408 through June 12, 2008.

• Ricky Holbrook – flagrant non-support.

Holbrook, 47, of P.O. Box 347, Ermine, is charged with failing to provide support for his minor child(ren). The grand jury says he owed $22,324.78 through June 12, 2008.

• Anthony Amburgey – flagrant non-support.

Amburgey, 36, of 1841 Big Branch Rd., Viper, is charged with failing to provide support for his minor child(ren). The grand jury says he owed $8,280.68 through June 12, 2008.

• Richard Sacco – flagrant non-support.

Sacco, 50, of 25 Millie Dr., Jacksonville Beach, Fla., is charged with failing to provide support for his minor child(ren). The grand jury says he owed $6,038.60 through June 12, 2008.
