Couple sentenced after pleading guilty to charges of distributing child porn




 

 

A Neon couple have pleaded guilty to child pornography charges almost a year after they were charged.

Martin W. Mosley, 32, was sentenced to 10 years in prison, while his wife, Clarissa Dawn Mosley, 24, was sentenced to five years in prison after pleading guilty in Letcher Circuit Court to the crimes committed between March 1, 2009 and Dec. 31, 2010.

The couple were arrested by Kentucky State Police after an investigation by Cybercrimes Unit of the office of Kentucky Attorney General Jack Conway after their indictment on one count of distribution of matter portraying a sexual performance by a minor and 61 counts of complicity to possession of matter portraying a sexual performance by a minor.

The charges stem from an undercover investigation that began in December 2009. Cybercrimes investigators executed a search warrant at the couple’s Neon home on January 20, 2011, with the assistance of the Fleming-Neon Police Department. A Letcher County grand jury indicted Martin and Clarissa Mosley on August 25, 2011. The indictment was unsealed after the couple’s arrest on September 14, 2011.

Prosecution of the case was handled by the office of Letcher Commonwealth’s Attorney Edison Banks II.

Martin Mosley, who was named in three separate indictments, pleaded guilty August 29 into charges contained in each of the indictments, all Class D felonies.

In one indictment, Mosley pleaded guilty to 52 counts of complicity to distribute matter portraying a sexual performance by a minor. Fifty-two videos were stored in files on a laptop computer found in the couple’s living room.

Mosley also pleaded guilty to nine counts of complicity to distribution of matter portraying a sexual performance by a minor. The plea agreement says Mosley possessed eight videos stored in files on a computer in the marital bedroom shared with his wife. Three additional videos were found in files on a computer found in the living room.

In a third indictment, Martin Mosley pleaded guilty to one count of complicity to the distribution of matter portraying a sexual performance by a minor. Sixty videos or films were found stored in a hard drive of his computer, which portrayed sexual performances between children and adults and children and animals.

Martin Mosley was sentenced to five years in prison for each indictment, with the nine counts of complicity distribution of matter portraying sexual performance by a minor to run consecutively with the 52 counts and concurrently with the one count of complicity distribution of matter portraying sexual performance by a minor.

Clarissa Mosley was also named in three indictments. She pleaded guilty to 52 counts of complicity to possession of matter portraying sexual performance by a minor, nine counts of complicity to possession of matter portraying sexual performance by a minor and one count of complicity to possession of matter portraying sexual performance by a minor. She was sentenced to five years in prison for each indictment, with the sentences to run concurrently.

Martin Mosley was represented in Letcher Circuit Court by Richard Counts and Clarissa Mosley was represented by Jennifer Milligan.
