Ex-teacher now facing federal child porn count

A former Letcher County teacher jailed two years ago to await trial on statutory rape and sexual abuse charges is now facing federal charges of producing child pornography.

Charles Evans Hall, 47, of Jackhorn, was indicted by a federal grand jury last week on charges of producing child pornography. The charges are apparently related to the same 14-year-old girl for whom he was originally charged in state court.

Hall was arrested on November 30, 2018, and then indicted the following January on charges of unlawful use of an electronic device to engage in sexual or prohibited activities, tampering with a witness, tampering with physical evidence, third-degree rape, first-degree sexual abuse, third-degree sodomy, possession or viewing of matter portraying a sexual performance by a minor, use of a minor in a sexual performance, first-degree sexual abuse and third-degree sodomy.

Hall was a teacher at the Letcher County Alternative School and a former assistant football coach at Letcher County Central High School at the time of his arrest. He was a teacher at Letcher Middle School when he was suspended in the spring of 2018 pending an investigation of an alleged sexual relationship with a 14-year-old girl, but a Kentucky State Police Post 13 investigation of that incident lapsed. Both police and the school district said at the time that the allegations were unsubstantiated, and sources say Hall was reinstated at the alternative school.

Hall, who was 45 at the time, was arrested after another investigation of the same incident by state police, and has been in the Letcher County Jail ever since in lieu of a $250,000 cash bond. He had sought release in June claiming that his life was in danger because of COVID-19, citing a health history of chronic bronchitis and upper respiratory infections. That motion was denied.

On Thursday, a federal grand jury alleged in a single count indictment that Hall convinced a minor “to engage in sexually explicit conduct for the purpose of producing a visual depiction of such conduct, knowing or having reason to know that such visual depiction would be transported using a means and facility of interstate and foreign commerce.”

If convicted of the federal charge, Hall faces not less than 15 years and up to 30 years in prison, a $250,000 fine, and supervised release of five years to life, in addition to more than $55,000 in special assessments.
