Five named in latest indictments




Five persons are named in new indictments returned by the Letcher County Grand Jury, including one man charged with trafficking in methamphetamine.

Jimmy “Scrappy” Cook, 37, of Sugar Run Road at Camp Branch, is charged with trafficking in a controlled substance ( two grams or more of methamphetamine) on May 11, possession of a controlled substance (first degree, first offense methamphetamine), tampering with evidence, possessing drug paraphernalia, and being a persistent felony offender.

Officer Alisha Congleton of the Letcher County Sheriff ’s Department testified in the case.

Congleton and Deputy Sheriff Barry Engle arrested Cook on May 11 after finding what they believed to be crystal meth during a visit to Cook’s home with social services.

According to Congleton, police were called to the home “in reference to a possible meth lab.” After Cook agreed to allow his home and person to be searched, “a container containing suspected crystal methwas located in Cook’s pocket,” Congleton wrote in an arrest citation.

“After Cook was placed in a police car a container was located on the ground containing suspected meth. Cook’s cell phone and digital scales with suspected meth residue was located behind the toilet inside the home,” Congleton wrote.

Congleton also wrote in the citation that Thomas Riley, an acquaintance of Cook’s, “stated that he observed (Cook) going into the bathroom as he exited the residence.” The citation says that $393 in cash was recovered from Cook’s wallet.

Others indicted are:

• James A. Webb — Theft by unlawful taking and being a persistent felony offender.

The grand jury says Webb, 52, of 64 Highland Branch, Haymond, took a utility car-hauling trailer belonging to Roscoe Perry on July 27. The trailer was located by Sheriff Danny Webb and returned to Perry.

• Raleigh D. Terry — Receiving stolen property ($500 or more, less than $10,000).

Terry, 32, of 11206 Hwy. 15, Jeremiah, is charged with receiving property belonging to Kentucky River Properties, LLC on Sept. 14, knowing that it had been stolen.

• Diana Nicholas — operating vehicle under the influence of alcohol/drugs (fourth or subsequent offense) and operating a vehicle on suspended/revoked license (third offense).

Nicholas, 49, of 262 Sackett Loop, Whitesburg, is accused of driving a vehicle on August 3 while she was under the influence of alcohol or drugs and with her driver’s license suspended or revoked.

• Bobby Gibson — Convicted felon in possession of a firearm.

Gibson, 28, of 46 Orange Dr., Whitesburg, a convicted felon, is charged with having a .410 shotgun in his possession. The crime allegedly occurred on July 25 when authorities found the weapon in a bedroom corner during a visit to Gibson’s home by the sheriff ’s office and officials with Letcher County Adult Drug Court.

Whitesburg Police Offi- cer Justin Hunsucker testified in the case.
