Grand jury charges couple in bank scam

Pair among 18 named in indictments



has named 18 people in 19 indictments, including an Ermine couple charged with theft by deception.

In separate indictments, the grand jury says Jimmy N. Niece, 57, and Kathy Niece, 47, both of P.O. Box 90, Ermine, obtained $1,685 from Community Trust Bank of Whitesburg on Sept. 15. The grand jury says Jimmy Niece created the false impression that his wife had taken his PIN number and ATM card without his knowledge and had withdrawn $1,685 from his account. The amount was redeposited in his account by the bank and he agreed to prosecute his wife for the recovery of the money, but had failed to do so.

Kathy Niece is charged with taking $1,685 using an ATM card issued by Community Trust Bank for her husband’s account on Sept. 2, knowing that the money would be repaid to the account by the bank.

The grand jury also indicted:

• Danny Lee Collins — two counts of wanton endangerment, criminal mischief, and retaliating against a participant in a legal pro cess.

Collins, 34, of 81 D Lane, Isom, is charged with firing two or more shots from a firearm at the residence of Bobby Milam Jr. and Jerruca Milam on Sept. 14. The grand jury says he damaged the mobile home of the Milams, in the belief that Bobby Milam could be called as a witness against him in a criminal prosecution.

• Harold P. Back — resisting arrest and assault.

The grand jury says Back, 21, of 354 Pert Creek Road, Whitesburg, resisted arrest by Sgt. Brian Damron of the Letcher County Sheriff’s Department on August 17. He is also charged with grabbing, pushing and wrestling Sgt. Damron to the ground.

• Jesse J. Thacker — carrying a concealed deadly weapon, failure to surrender his operator’s license, and promoting contraband.

Thacker, 22, of 9701 Baughman Lane, North Fort Myers, Fla., is charged with carrying a concealed deadly weapon on Sept. 20 and failing to surrender his operator’s license to the Transportation Cabinet after its suspension and/or revocation. He is also charged with introducing dangerous contraband into the Letcher County Jail.

Jenkins Police Officer Anthony Maggard testified in the case.

• Shiloh Cody Adams — burglary, theft of a firearm, two counts of wanton endangerment, assault and resisting arrest.

The indictment charges Adams, 23, of 377 Black Bottom Road, Jeremiah, with taking a 12- gauge shotgun from the residence of Courtney “Toby” Adams on Sept. 27. The grand jury says he pointed the shotgun at Dustin Adams and Courtney “Toby” Adams and struck Courtney “Toby” Adams. He is also charged with resisting arrest by Sgt. Brian Damron of the Letcher County Sheriff’s Department.

• Nicholas Bentley Jr. a/k/a Nickey Bentley Jr. — complicity to theft.

The indictment charges Bentley, 27, of 287 Lighthouse Lane, Jenkins, with acting alone or in complicity with Randy Church and Gregory Smith in stealing a 1986 F-250 Ford fourwheel drive pickup truck owned by Creed Newsome on May 23.

Creed Newsome testified in the case.

• Terry Wayne Anderson — theft by unlawful taking and being a persistent felony offender.

The grand jury charges that Anderson, 42, of 173 May St., McDowell, took a Sony Handy Camcorder and camera battery valued at $1,229.23 from the Whitesburg Wal-Mart on Nov. 4.

Whitesburg Police Officer Phillip Slone testified in the case.

• Kenneth Wayne Burke — receiving stolen property and being a persistent felony offender.

Burke, 25, of P.O. Box 892, Neon, is charged with having in his possession in November 2008 a stolen automobile.

Neon Police Officer Kevin Fields testified in the case.

• Rhonda Sue Brashears — seven counts of theft by failure to make required disposition of property (over $300) and one count of theft by failure to make required disposition of property (under $300).

The grand jury says Brashears, 40, of 3500 Hwy. 931 S, Whitesburg, obtained $3,877.31 from the corporate checking account of BCA Inc. in February 2008, $876.22 in April 2008, $719 in May 2008, $2,365.45 in June 2008, $2,989.99 in July 2008, $1,850.94 in August 2008, and $6,751.43 in September 2008. She is also charged with obtained $186.61 from the corporate checking account of BCA Inc. in March 2008.

Charged under an amended indictment is:

• Homer Boggs Jr. — burglary and theft by unlawful taking.

The grand jury says Boggs, 34, of 400 Harold Street, Harlan, entered a shed/storage building of Danny Boggs on August 29, 2008 and took a Troy Built pressure washer.

• George Wilson — flagrant non support.

In two separate indictments, Wilson, 50, of 1676 Bill Moore Br., Whitesburg, is charged with failing to provided support for his minor child(ren). One indictment states he owes $4,809.39 for the period of March 1, 1998 through Nov. 20, and the other indictment states he owes $15,104.08 for the period of October 3, 1989 through November 20A.

• Daniel Combs — flagrant non-support.

Combs, 29, of 1726 Carcassonne Road, Blackey, is charged with failing to provide support for his three minor children. The grand jury says he owes $8,308.50 for the period of July 28 through Nov. 13.

• Lloyd Jones — flagrant nonsupport.

Jones, 37, of 306 Morningside Dr., Thompson, Ga. 30824, is charged with failing to provide support for his two minor children. The grand jury says he owes $1,818 for the period of May 1 through Nov. 20.

• Walter Polly — flagrant nonsupport.

Polly, 61, of P.O. Box 765, Pigeon Forge, Tenn., is charged with failing to provide support for his minor child(ren). The grand jury says he owes $51,346.51 for the period of June 3, 1982 through Nov. 20.

• John Barnett — flagrant non-support.

Barnett, 40, of 356 Hwy. 3409, McRoberts, is charged with failing to provide support for his two minor children. The grand jury says he owes $6,432.40 for the period of August 3, 2007 through Nov. 20.

• Kevin Butler— flagrant non-support.

Butler, 29, of 357 Behler, Rd., Ravenna, Mich., 49451, is charged with failing to provide support for his minor child(ren). The grand jury says he owes $4,297.33 for the period of July 28 through Nov. 20.

• Rodney Wynn — flagrant non-support.

Wynn, 42, of 12063 Hwy. 160, Whitesburg, is charged with failing to provide support for his two minor children. The grand jury says he owes $21,972.83 for the period of April 21, 2000 through Nov. 20.

• Jeff Elswick — flagrant nonsupport.

Elswick, 43, of P.O. Box 1435, Jenkins, is charged with failing to provide support for his minor child. The grand jury says he owes $2,612.64 for the period of May 2007 through Nov. 6.
