Grand jury indictments name 6




A Letcher County grand jury says a 34-year-old Pike County man caused serious physical injury to his ex-wife when he assaulted her in a hospital parking lot at Jenkins.

The grand jury last week returned an indictment against Robert Eugene Stewart Jr., of Draffin, charging him with second-degree assault and second-degree possession of a controlled substance.

Stewart is accused of striking his ex-wife, Tonya Stewart, in the face with his fists, breaking her nose and other facial bones which required extensive surgery to repair. The assault took place on December 30 in a parking lot at Jenkins Community Hospital, where Tonya Stewart was a nurse in the emergency room.

Jenkins Police Officer Anthony Maggard and the victim testified in the case.

Five others were indicted by the jury on charges ranging from bank robbery to failure to appear in court. Those indicted and the charges against them are:

• Dustin Allen Adams — first-degree robbery, theft by unlawful taking (more than $300), trafficking in marijuana (more than eight ounces), receiving stolen property, and possession of drug paraphernalia.

Adams, 25, of 2956 Highway 7 South, is accused by the jury of threatening the use of physical force while armed with a pistol and in the course of committing a theft of currency valued at more than $300 which was deposited at the Isom branch of Community Trust Bank on January 21.

The grand jury heard testimony from Kentucky State Police Detective Randy Combs.

• James Robert Lynam — first-degree bail jumping.

The grand jury accuses Lynam, 32, of 291 Buck Creek Road, Whitesburg, of intentionally failing to appear for a preliminary hearing in Letcher District Court.

Letcher County Sheriff’s Deputy Mickey Stines testified in the case.

• Stefan Gardiner — flagrant non-support.

Gardiner, 38, of 120 12th Street, Apartment 5, Norton, Virginia, is charged with owing $4,901 in child support for the period from September 15, 2006 to January 20, 2009.

Amy Gosnell of the Letcher County Division of Child Support Enforcement testified in the case.

• Ronald Powell — flagrant non-support.

Powell, 44, of 400 Turner Street, Paris, is charged with owing $37,815 in child support.

Gosnell testified in the case.

• Bobby Belcher — flagrant non-support

Belcher, 32, of 109 Morning Glory Lane, McRoberts, is charged with owing $32,674 in child support for the period from March 12, 2001 to January 20, 2009.

The grand jury heard testimony from Gosnell.
