Grand jury indicts 12




The Letcher County Grand Jury has named 12 people in 15 indictments, including a Jenkins man charged with complicity to burglary, complicity to robbery, complicity to assault, and terroristic threatening.

The grand jury says Ricky Allen Bates Jr., 24, 112 Libby Lane, Jenkins, entered the home of James McPherson at 180 Rocky Hollow Road, Jenkins, with Melissa L. Slone on August 14, 2009. He and Slone are accused of threatening McPherson and/or members of his family with a wood club and dumbbell weight and injuring McPherson. He is also charged with being a persistent felony offender.

Jenkins Police Officer Anthony Maggard testified in the case.

Also indicted by the grand jury are:

• Ronnie Shepherd — possession of a controlled substance, fleeing or evading police, resisting arrest, public intoxication, use or possession of drug paraphernalia, and being a persistent felony offender.

Shepherd, 26, of 650 Puncheon Camp Road, Cornettsville, is charged with possessing OxyContin on July 5, 2009. He is also charged with disobeying an order to stop given by Police Officer Homer Pigman and/or Police Officer Jason Slone and with resisting arrest.

Police Officer Jason Slone testified in the case.

• Billy Baker Jr. — identity theft and being a persistent felony offender.

The indictment charges Baker, 25, of 355 Pert Creek Road, Whitesburg, with using the identifying information of another person when he presented a prescription at the Jenkins Rite-Aid pharmacy on August 4, 2008.

Jenkins Police Sgt. Adam Swindell testified in the case.

• Jerry Leland Day II — theft by deception, forgery, and possession of a forged instrument.

The grand jury says Day, 28, 100 Coleman Lane, Whitesburg, obtained $350 from Whitaker Bank by cashing a stolen and forged check on the account of Coleman Day on July 29, 2009.

In a separate indictment, Jerry Day is accused of theft by deception, forgery, and possession of a forged instrument. He is charged with cashing a stolen and forged check for $600 on the account of Coleman Day on August 3, 2009.

Letcher County Sheriff Danny Webb testified in both cases.

• Christine N. Moore — possession of a controlled substance (second degree), possession of a controlled substance (third degree), possession of a controlled substance not in the original container, and possession or use of drug paraphernalia.

Moore, 27, 578 Bentley Loop, P.O. Box 1322, Jenkins, is accused of possessing hydrocodone and Alprazolam on August 25, 2009.

Jenkins Police Officer Timothy Miller testified in the case.

• Sid Gibson Jr. — assault, resisting arrest, public intoxication, and two counts of terroristic threatening.

Gibson, 37, 256 Anderson Branch Road, Elkhorn, is charged with kicking Jenkins Police Sgt. Adam Swindell on April 28, 2009, and with resisting arrest by Swindell and Jenkins Police Officer Timothy Miller.

• Bobby Briggs — assault

The grand jury accuses Briggs, 34, 166 Bill Lewis Hollow, Jenkins, of injuring Latasha Cook by striking her several times with a large metal flashlight on July 5, 2009.

• Tabitha Sally — bail jumping.

Sally, 28, 2228 Bishop Ridge, Falmouth, is charged with failing to appear in the Letcher Circuit Courtroom on August 11, 2009, in connection with a charge of having committed a felony.

In a separate indictment, Sally is charged with failing to appear in the Letcher Circuit Courtroom on August 11, 2004, in connection with a charge of having committed a felony.

Letcher County Deputy Clerk Sandra Wright testified in both cases.

The Letcher County Grand Jury has charged four people with flagrant non-support for failing to provide support for their minor children.

Those indicted are:

• Joseph Whitaker, 32, 5456 Hwy. 1103, Hallie, who is charged with owing $4,362.23 in child support for the period ending August 31, 2009.

In a separate indictment, he is charged with owing $12,218.17 in child support for the period ending August 31, 2009.

• Mark Smith, 36, 140 Beaver Street, Forest City, N.C., who is charged with owing $3,087.58 in child support for the period ending August 31, 2009.

• Arthur Richardson 38, P.O. Box 791, Neon, who is charged with owing $10,018.53 in child support for the period ending August 31, 2009.

• Oliver Fleming, 37, P.O. Box 53, Jackhorn, who is charged with owing $16,613.36 in child support for the period ending August 31, 2009.
