Grand jury names five in new indictments

The Letcher Grand Jury has named five people in indictments including a man charged with second-degree strangulation

Jimmy Darrel Niece, 62, of 271 Ky. Hwy. 588, Whitesburg, is charged with impeding the normal breathing or circulation of the blood by applying pressure on the throat or neck, or blocking the nose or mouth of the other person. Niece is also accused of fourth-degree assault for causing injury to the other person.

Kentucky State Trooper Branden Watts testified in the case.

Others indicted are:

• Gary Combs, 55, of 154 Red Bud Lane, Isom, who is charged with receiving stolen property. The grand jury says Combs had property stolen from Dickie Adams in his possession.

Letcher County Sheriff Mickey Stines testified in the case.

• Crystal Dawn Callihan, 36, of 33 Margie & Ed Drive, Whitesburg, who is named in an indictment containing seven counts. Callihan is charged with public intoxication (excludes alcohol), resisting arrest, second-degree disorderly conduct, first-degree criminal possession of a controlled substance (less than two grams of methamphetamine, first offense), third-degree criminal possession of a controlled substance (drug unspecified), criminal use/possession of drug paraphernalia and third-degree assault.

Callihan is accused of attempting to prevent Letcher County Deputy Sheriff Cory Harris from arresting her and causing or attempting to cause injury. Callihan is charged with being under the influence of a controlled substance, and with creating a risk in a public place by fighting or by threatening behavior.

• James Dale Kincer, 43, who is charged with first-degree fleeing or evading police (motor vehicle), resisting arrest and two counts of third-degree assault. Kincer is also charged with attempting to injure Jenkins City Officer Hunter Holbrook and Letcher County Deputy Sheriff Gavin Fleming.

• Jeffrey Luther Polly, 57, of 48 Fifth Street, Whitesburg, who is charged with failure to maintain required insurance (first offense), no registration plate, operating a vehicle with suspended/revoked operator’s license, failure to wear seat belt, rear license not illuminated, failure to produce proof of insurance, no registration receipt, first-degree criminal possession of controlled substance (methamphetamine) and use/possession of drug paraphernalia.

Letcher County Deputy Sheriff Gavin Fleming testified in the case.
