40507 has applied for a renewal of an existing
surface coal mining and reclamation operation.
The operation will disturb 759.55 surface acres
and will underlie 739.3 acres for a total permit
area of 1498.85 acres located 3 miles south of
Carrie in Letcher County.
The permit area is approximately 2 miles north of
the junction of Route 803’s with Route 113 and
located primarily on the ridge between the Left
and Right Forks of Millstone Creek.
The proposed operation is located on the Mayking
and Jenkins West U.S.G.S. 7 1/2 minute quadrangle maps. The surface area to be disturbed
is owned by Ricky D. Kirk and Jerry Wells. The
operation will use the contour, area, underground,
auger, highwall miner methods of mining.
The application has been filed for public inspection at the Department for Natural Resources,

notice is hereby given that Sapphire Coal Company, 1073 Riverview Street Grundy, Virginia
24614 has applied for a renewal application of an
existing coal refuse facility and surface coal mining
and reclamation operation located 1.0 mile south
of Polly in Letcher County, Kentucky. The existing
operation disturbs 239.76 surface acres for a total
permitted area of 239.76 acres.
The existing operation is approximately 1.0 mile
southeast of the junction of KY 931’s junction
with KY 1862 and located 0.05 mile east of Camp
Branch. The existing operation is located on the
Mayking U.S.G.S. 7 ½ minute quadrangle map.
The surface area to be disturbed is owned by
Earnest Cook Heirs (Sandra Sue Cook, Michael K.
Cook, Randy A. Cook, Mark Wayne Cook, Earnest
Stephen Cook, Earnestine Franks), James Elswick, Danny Kiser and Sapphire Coal Company.

In accordance with KRS 350.055, notice is hereby
given that Blue Diamond Mining, LLC, 3228 Summit Square Place, Suite 180, Lexington, Kentucky
40509, has applied for a renewal of a permit for
an underground coal mining operation located approximately located 1.7 mile southwest of Delphia
in Letcher, Perry, and Harlan Counties. The proposed operation will disturb 40.37 surface acres.
The operation is approximately 1.7 miles southeast of KY 463’s junction with Stony Fork Road
and located 10 feet east of Stony Fork.
The operation is located on the Tilford, Leatherwood, and Louellen USGS 7½ minute quadrangle
maps. The surface area to be disturbed by this
renewal is owned Kentucky River Properties LLC.
The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village
Lane, P.O. Box 851, Hazard, Kentucky 41702.

NOTICE OF BOND RELEASE
Pursuant to Application Number 897-0376
In accordance with KRS 350.093, notice is hereby
given that Nally & Hamilton Enterprises, Inc., P.O.
Box 157, Bardstown, Kentucky 40004 has applied
for a Phase III Bond Release on Increment no’s. 2
and 6 and a Phase II and Phase III Bond Release
on Increment no. 4 of Permit No 897-0376 which
was last issued September 1, 2011. Increment no.
2 covers an area of approximately 350.45 acres
of surface area. Increment 4 covers an area of
approximately 95.93 acres of surface area. Increment 6 covers an area of approximately 445.63
acres of surface area.
The permit area is approximately 2.6 miles east
from KY 699’s junction with Kentucky 221 at Big
Laurel and located 2.70 miles southwest of Leatherwood and located in Harlan, Perry & Letcher
Counties with Increments 2, 4 and 6 being located
in Harlan and Letcher Counties.
The bond now in effect for Increment No.2 is
a surety bond in the amount of $167,400.00 of
which 100% of the original amount of $349,600.00
is to be included in this application for release.
The bond now in effect for Increment No.4 is

a surety bond in the amount of $104,700.00 of
which 100% of the original amount of $251,300.00
is to be included in this application for release.
The bond now in effect for Increment No.6 is a
surety bond and a cash bond in the amount of
$204,700.00 of which 100% of the original amount
of $1,392,700.00 is to be included in this application for release.
Reclamation work performed included: All mining
area was backfilled and graded with all highwalls
eliminated and the area was seeded, this work
was completed in the Spring of 2002.

public hearing or informal conference must be
filed with the Director, Division of Field Services,
300 Sower Blvd., Frankfort, Kentucky 40601 by
Friday, May 31, 2019.
A public hearing on the application has been
scheduled for Wednesday, June 5, 2019 at 10:00,
at the Department for Natural Resources, Hazard
Regional Office, 556 Village Lane, Hazard Kentucky 41702. This hearing will be canceled if no
request for a hearing or informal conference is
received by Friday, May 31, 2019.

The operation will underlie land owned by ACIN
LLC, and Jesse S. Collins heir: William Collins.
The application has been filed for public inspection
