SALE By virtue of a Judgment and Order of Sale and Order Referring Case to Master Commissioner for Judicial Sale entered by the Letcher Circuit Court on the 1st day of July 2019, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Wednesday, August 7, 2019, beginning on or about the hour of 1:30 p.m., local time and continuing until the sale is concluded to the highest bidder at public auction, the following described real property lying in Letcher County, Kentucky: Property Address: 1250 Highway 931 South Whitesburg, KY 41858 Parcel ID: 058-20-00- 020.00 The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of a deposit of 10% of the purchase price to be paid at the time of the sale with the balance on credit for 30 days. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety approved by the Master Commissioner to secure the unpaid balance of the purchase price. The bond shall bear interest at the rate of 3.87500% per annum from the date of sale until paid. Failure of the purchaser to effect such insurance coverage shall not affect the validity of the sale or the purchaser’s liability thereunder but shall entitle but not require any party adjudicated an interest in the Real Property, after giving notice to the Master Commissioner, to effect said insurance and furnish evidence of the policy to the Master Commissioner. The premium on the insurance policy shall then be charged to the purchaser as purchaser’s cost. The purchaser at the Master Commissioner’s sale shall take the Real Property free and clear of the claims of the parties to this action, properly before the Court subject to the following: a. All current year ad valorem real estate taxes not yet due and payable and all taxes due thereafter. b. Easements, restrictions and stipulations of record affecting the Real Property. c. In accordance with the provisions of KRS 350.055, notice is hereby given that Blue Diamond Mining, LLC, 3228 Summit Square Place, Suite 180, Lexington, Kentucky 40509 has applied for a permit renewal to an existing haul road permit located 0.38 miles east of Kodak and situated in Knott, Letcher and Perry Counties. This operation will affect 63.73 surface acres.

The proposed operation is approximately 2.27 miles southeast from KY Route 1095’s junction with KY Route 15 and located 0.23 miles northeast of Montgomery Creek.

The operation is located on the Blackey and Vicco USGS 7 1/2 minute quadrangle maps. The surface area to be disturbed is owned by Carrs Fork Corporation and Montgomery Coal Corporation.

The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, P.O. Box 851, Hazard, Kentucky 41702. NOTICE OF INTENTION TO MINE

Pursuant to Application No. 867-5333, Renewal 7

In accordance with KRS 350.055, notice is hereby given that Blue Diamond Mining, LLC, 3228 Summit Square Place, Suite 180, Lexington, Kentucky 40509, has applied for a renewal of a permit for an underground coal mining and reclamation operation. This operation will affect 34.0 surface acres and underlie 2,296.90 acres and the total area within the permit boundary will be 2,330.90 acres. The operation is located 2.3 mile southwest of Banks in Letcher and Perry Counties.

The operation is approximately 3.4 miles southwest of KY 1103’s junction with Turkey Creek Road and located on Turkey Creek. The nearest named stream is Turkey Creek.

The operation is located on the Tilford USGS 7½ minute quadrangle map. The surface area to be disturbed by this renewal is owned Kentucky River Properties, LLC and ACIN LLC. The operation underlies land owned by Kentucky River Properties LLC, ACIN LLC, William W Skewes, Doc Cornett, and Mason Caudill.

The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, P.O. Box 851, Hazard, Kentucky 41702. NOTICE OF BOND RELEASE

Pursuant to Permit Number 867-0399

In accordance with KRS 350.093, notice is hereby given that Nally & Hamilton Enterprises, Inc., P.O. Box 157, Bardstown, Kentucky 40004 has applied for a Phase III Bond Release on Increment No. 1 of permit no. 867-0399 which was last issued August 28, 2018. Increment 1 covers an area of approximately 58.36 acres of surface area. The permit area is located approximately 0.75 miles north of Hot Spot in Letcher County.

The permit area is approximately 0.75 miles north from KY 160’s junction with KY 588, and located 0.20 mile southwest of Johnson Branch.

The bond now in effect for Increment No. 1 is a surety bond in the amount of $12,800.00 of which 100% of the original amount of $145,900.00 is to be included in this application for release. All mining area was backfilled and graded with all highwalls eliminated and the area was seeded, this work was completed in Fall of 2011.

Written comments, objection and request for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Blvd., Frankfort, Kentucky 40601 by Friday, September 6, 2019.

A public hearing on the application has been scheduled for Wednesday September 11, 2019 at 10:00 a.m. the Department for Natural Resources, Hazard Regional Office, 556 Village Lane, Hazard , Kentucky 41702. This hearing will be canceled if no request for a hearing or informal conference is received by Friday September 6, 2019.
