A Floyd County man has pleaded guilty to charges resulting from the theft of a video camera at the Whitesburg Walmart.
Letcher Commonwealth’s Attorney Edison G. Banks II said Terry Wayne Anderson, 44, of 173 May St., McDowell, pleaded guilty on Jan. 6 to theft by unlawful taking (more than $300) and being a persistent felony offender.
Anderson stole a Sony Handycam Camcorder and camera battery valued at $1,229.23 from the Whitesburg Walmart on Nov. 4, 2008.
His plea agreement includes a maximum prison sentence of 10 years with five years probated. Anderson will receive credit for serving 210 days in jail. Anderson must serve 180 days in jail or 365 days home incarceration.
As part of the agreement, he must pay a supervision fee of $ 15 a month and a drug testing fee of $10 per month while on active supervision in addition to paying $130 in court costs to the Letcher Circuit Clerk’s office.
Anderson is to stay at least 500 feet away from the premises of the Whitesburg Walmart.
