TO MINE

Pursuant To Application # 867-0552,
Operator Change 1

In accordance with 405 KAR 8:010, notice is
hereby given that Nally & Hamilton Enterprises,
Inc., P.O. Box 157, Bardstown, Kentucky 40004
intends to revise Permit 867-0552 to add an
additional operator. The additional operator will
be Commonwealth Mining, LLC, 145 George
Street Suite E, Beckley, West Virginia 25801.
The operator presently approved in the permit is
the permittee.

The proposed operation is ±3.5 miles east of the
junction of US 119 and SR 932 and the nearest
stream is Meadow Branch. The operation is located on the Flat Gap and Whitesburg U.S.G.S.
7 ½ minute quadrangle maps.

The application has been filed for public inspection
at the Department for Surface Mining
Reclamation and Enforcement, Middlesboro
Regional Office, 1804 East Cumberland Avenue,
Middlesboro, Kentucky 40965. Written comments
or objections must be filed with the Director,
Division of Permits, 300 Sower Blvd., Frankfort,
Kentucky 40601. All comments or objections must
be received within fifteen (15) days of today’s date.

Renewal 5

In accordance with KRS 350.055, notice is hereby
given that Sapphire Coal Company, 1073 Riverview Street, Grundy, VA 24614, has applied for
renewal of a permit for an existing underground
coal mining and reclamation operation located
0.5 miles northeast of Hot Spot in Letcher County.
The proposed operation will disturb 48.73 surface
acres a total area of 48.73 acres within the permit
boundary.

The operation is approximately 0.5 miles northeast
from KY Highway 160’s junction with Johnson
Branch Road and located south of Smoot Creek.
The operation is located on the Blackey/Roxana
U.S.G.S. 7.5 minute quadrangle map. The operation will use the underground room and pillar
mining method.

The surface owners for the permit area is Kentucky River Coal Corporation, Sapphire Coal
Company, and KYCOGA Company LLC.

The application has been filed for public inspection
at the Department for Mining Reclamation and
Enforcement’s Pikeville Regional Office, 121 Mays
Branch Road, Pikeville, Kentucky 41501-9331.
Written comments, objections or requests for a
permit conference must be filed with the Director,
Division of Mine Permits, 300 Sower Boulevard,
Frankfort, Kentucky 40601.
