Commissioner of the
Letcher Circuit Court
will offer for sale at the
courthouse door of the
Letcher County Courthouse in the City of
Whitesburg, Kentucky
on Thursday, June 3,
2021, beginning on
or about the hour of
11:15 a.m. local time
and continuing until the
sale is concluded to the
highest bidder at public
auction, the following
real estate, situated in
Letcher County, Kentucky: Beginning on a steel
stake at the edge of
College View Avenue;
thence around the hill
120 feet with College
View Avenue; thence
turning a right angle
and Doe the Hill in a
Easterly direction 66
feet to a steel stake;
thence in a Southerly
direction and at a right

The purchaser or successful bidder can elect
to pay cash at the time
of said sale or at the
option of the bidder on
the terms of a deposit
of ten percent (10%)
of the purchase price
with the balance payable within sixty (60)
days except the deposit shall be waived if
the Cross-Claimant is
the successful bidder.
If the purchase price
is not paid in full, the
successful bidder shall
execute a bond at the
time of sale with sufficient surety to secure
the unpaid balance of
the purchase price and
said bond shall constitute a lien on the said
property until paid. The
bond shall bear interest
at the rate of 12% per
annum from the date
of sale until paid. The
bond surety must be
present at the sale and
execute the Sale Bond
and Affidavit of Surety.
If the Cross-Claimant
is the successful bidder

and its bid is over
and above its judgment amount, it shall
be required to pay the
difference between its
judgment amount and
its bid within thirty (30)
days from the date of
sale with interest at the
rate of 12% per annum
on any amount which
exceeds its judgment.
The property shall be
sold free and clear of
all liens and encumbrances of any party to
this action, except the
following:
a. The current year ad
valorem taxes and all
subsequent taxes due
thereafter, including attorney fees and costs;
b. Easement, restrictions and stipulations
of record;
c. Assessments for
public improvements
levied against the property, if any; and
d. Any facts which an
accurate survey and inspection of the property
may disclose.
The costs involved in
this action are judgment for Letcher
County in the sum of
$ 1,488.36 together
with interest at the
statutory rate of 6%
from date of entry of
Judgment until paid
plus any continuing
costs; In rem Judgment for Tracy Crase in
the amount of $349.46
together with interest
at the statutory rate of
6% from date of entry
of Judgment until paid;
Tracy Crase costs and
attorney fees in the
amount of $401.54;
the cost of this action
and its costs herein
expended, including
the cost of the sale.
Health and safety measures to include social
distancing and the use
of facial coverings over
the nose and mouth will
be required at all sales.
