The purchaser or successful bidder can elect
to pay cash at the time
of said sale or at the
option of the bidder on
the terms of a deposit
of ten percent (10%)
of the purchase price
with the balance payable within sixty (60)
days except the deposit shall be waived if
the Cross-Claimant is
the successful bidder.
If the purchase price
is not paid in full, the
successful bidder shall
execute a bond at the
time of sale with sufficient surety to secure
the unpaid balance of
the purchase price and
said bond shall constitute a lien on the said
property until paid. The
bond shall bear interest
at the rate of 12% per
annum from the date
of sale until paid. The
bond surety must be
present at the sale and
execute the Sale Bond
and Affidavit of Surety.
If the Cross-Claimant
is the successful bidder and its bid is over
and above its judgment amount, it shall
be required to pay the
difference between its
judgment amount and
its bid within thirty (30)
days from the date of
sale with interest at the
rate of 12% per annum
on any amount which
exceeds its judgment.

sold free and clear of
all liens and encumbrances of any party to

subsequent taxes due

The purchaser or successful bidder can elect

twelve percent (12%)

The purchaser shall
be required to execute
bond with good and
sufficient surety thereon as approved by the

and effect as a judgment and shall remain
and be a lien on the
subject property until the purchase price
therefore is fully paid.
It is further provided
that the Subject Property includes insurable
improvements and the
successful bidder at
the sale shall, at such
bidder’s own expense,
carry fire and extended
insurance coverage
on said improvements
from the date of sale
until the purchase
price is fully paid, in
the amount of the Court
appraised value of said
improvements or the
amount of the unpaid
balance of the purchase price, whichever
is less, at a minimum,
with a loss payable
clause to the Master
Commissioner of the
Letcher Circuit Court
and the Plaintiff. Failure of the purchaser to
obtain such insurance
shall not affect the
validity of the sale or
the purchaser’s liability
thereunder, but shall
entitle, but not require,
Plaintiff to obtain said
insurance and furnish
the policy or premium
thereon and the proper
portion thereof shall
be charged to the purchaser as purchaser’s
costs.
The purchaser shall
be required to assume
and pay all taxes or
assessments upon the
Subject Property for
the current tax year
and all subsequent
years.
The Subject Property shall otherwise
be sold free and clear
of any right, title or
interest of all parties
of the action and all
liens and encumbrances thereon, excepting easements and
restrictions of record
in the Letcher County
Clerk’s Office and such
right of redemption as
may exist in favor of
Defendant(s).
The costs involved in
this action are judgment for FAHE as of
January 28, 2021 in
the principal balance
of Sixteen Thousand

Nine and 54/100 Dollars($ 16,869.54) together with accrued
interest thereon at the
rate of 0.00 percent per
annum from the date
of default until paid;
for late fees, which as
of January 28, 2021
totaled Two Hundred

including but not limited to a release fee of

property preservation
