In accordance with 405 KRS 350.055, notice is
hereby given that, Nally and Hamilton Enterprises,
Inc., P.O. Box 157, Bardstown, KY 40004, has
applied for a permit for a surface coal mining
and reclamation operation affecting 119.59 acres
located approximately 2.3 miles northeast of Eolia
in Letcher County.

The proposed operation is approximately 3.5 miles
east of the junction of US 119 and State Route KY
932 along the Poor Fork of the Cumberland River.
The proposed operation is located on the Flat Gap
and Whitesburg U.S.G.S. 7-1/2 minute quadrangle
maps The operation will be a haul road only.

The surface area is owned by ACIN, LLC, and

Pursuant to Application Number 867-5377,
Amendment #8

In accordance with KRS 350.070, notice is hereby
given that Mark Energy, LLC; 8880 Cedar Springs
Lane, Suite 105, Knoxville, TN 37923 has applied
for an amendment to an existing underground coal
mining and reclamation operation located 3.03
miles southeast of Oven Fork in Letcher County.
The amendment will add 13.04 acres of surface
disturbance making a total of 178.52 acres within
the amended permit boundary.

The proposed amendment area is approximately
2.79 miles southeast from US 119’s junction with
KY 806 and located 0.38 miles south of Franks
Creek. The latitude is 37°01’10”. The longitude
is 82°47’30”.

The proposed amendment is located on the
Whitesburg & Flat Gap U.S.G.S. 7 1/2 Minute
Quadrangle Maps. The surface area to be disturbed by the amendment is owned by ACIN,
LLC. The operation will use the contour and auger
method of surface mining.

The amendment application has been filed for
public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, Hazard, Kentucky 41702.

In accordance with KRS 350.055, notice is
hereby given that Sapphire Coal Company, 1073
Riverview Street, Grundy, VA 24614, has applied
for renewal of a permit for an existing surface
coal mining and reclamation operation located
0.6 miles northeast of Colson in Letcher County.
The operation will disturb 411.60 surface acres,
making a total area of 411.60 acres within the
permit boundary.

The operation is approximately 0.6 miles northeast
from KY Route 931 and KY Route 1410 near Colson in Letcher County and is located 0.05 miles
east of Buck Creek.

The operation is located on the Mayking U.S.G.S.
7.5 minute quadrangle map. The operation will use
the underground room and pillar mining method.

Renewal

In accordance with KRS 350.055, notice is hereby
given that Revelation Energy, LLC, 500 Lee St,
Suite 900, Charleston, WV 25301, has applied
for renewal of a permit for an underground coal
mining operation located 2.0 miles east of Partridge in Letcher County. The operation disturbs
22.97 surface area of which 13.32 acres overlie
underground area and underlying an additional
16,404.18 acres of underground area for a total
of 16,413.83 acres. No new acres are affected
by the transfer.

The operation is approximately 2.5 miles northeast
from KY 3404’s junction with US 119 and located
adjacent to the Poor Fork of the Cumberland
River. The latitude is 37o01’51” N. The longitude
is 82o51’52” W.

The operation is located on the Roxana, Whitesburg, Appalachia and Benham U.S.G.S. 7 ½ minute quadrangle maps. The surface area disturbed
is owned by ACIN LLC. The operation underlies
land owned by ACIN LLC.

The application has been filed for public inspection
at the Department for Surface Mining Reclamation
and Enforcement’s Hazard Regional Office, 556

hereby given that MJK Mining Incorporated, P.O.
Box 3668, 166 Holly Drive, Pikeville, KY 41502
intends to transfer Permit No. 867-0517 to Phelps
Energy and Resources, LLC, 155 McCoy Caney
Road, Phelps, KY 41553. The new Permit No.
will be 867-0557. The operation disturbs 123.81
surface acres. No new acreage is affected by
this transfer.

The operation is located 1.14 miles North of Van
in Letcher County. The operation is approximately
0.37 miles north of the junction of US 15/160
and Trace Fork Road along Trace Fork of Smoot
Creek of the North Fork of the Kentucky River.
The operation is located on the Blackey U.S.G.S.
7-1/2 minute quadrangle map.

PUBLIC NOTICE
Floodplain and Wetland Notice of Explanation
Activity in a 100-Year Floodplain

To: All interested Agencies all Federal, State, and Local Groups and Individuals

This is to give notice that the City of Fleming-Neon under 24 CFR Part 58 has conducted an evaluation as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at
24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to
determine the potential affect that its project in the oodplain and wetland will have on the human
environment for Fleming-Neon Sewer Rehabilitation Project under SX21133015. The proposed
project is located in the City of Fleming-Neon, Letcher County, Kentucky. The purpose of this
project is to create a working map of the sewer system, suitable for a ow study and for use during
construction. The project will perform ow monitoring at three to ve key locations in the sewer
system to determine where inow & inltration (I/I) is excessive. The project will also inspect the
manholes in the area to be rehabilitated and televise and smoke test the sewers which are found
to have excessive I/I. There will be approximately 75,679 Linear Feet of 10” and 14” sewer line
smoked and televised. Then the project will construct repairs to the sewers and manholes. The
smoke test results will be used to communicate to private property owners the needs to correct
the inow sources such as roof downspouts connected to the sewer and missing clean-out caps.

The City of Fleming-Neon has considered the following alternatives and mitigation measures to
be taken to minimize adverse impacts and to restore and preserve natural and benecial values:
The City of Fleming-Neon has evaluated all alternatives. The rst option is to continue making
repairs to the sewer system, but that would not be cost efcient. The second option is to do nothing and continue operations, but that is not feasible. The third option is to construct the project as
designed. Part of the project may be in the 100-year oodplain as designated by the September
16, 2015 FEMA Floodplain Maps; with very minimal impacts to the oodplain areas.

The City of Fleming-Neon has re-evaluated the alternatives to building in the oodplain and has
determined that it has no practicable alternative. Environmental les that document compliance
with steps 3 through 6 of [Executive Order 11988 and/or 11990], are available for public inspection,
review and copying upon request at the times and location delineated in the last paragraph of this
notice for receipt of comments. This activity will have no signicant impact on the environment
for the following reasons:

This project is a rehabilitation project and will have no signicant impact on the environment. This
project promotes human health by improving the performance of the wastewater treatment plant
and reducing sewer ows.
