TO MINE

Pursuant to Application Number 867-5377
Amendment #8

In accordance with KRS 350.070, notice is
hereby given that Mark Energy, LLC; P.O. Box
283; Whitesburg, Kentucky 41858 has applied for
an amendment to an existing underground coal
mining and reclamation operation located 3.03
miles southeast of Oven Fork in Letcher County.
The amendment will add 22.56 acres of surface
disturbance making a total of 188.04 acres within
the amended permit boundary.

The proposed amendment area is approximately
2.79 miles southeast from US 119’s junction with
KY806 and located 0.38 miles south of Franks
Creek. The latitude is 370 01’10”. The longitude
is 820 47’ 30”.

The proposed amendment is located on the
Whitesburg & Flat Gap U.S.G.S. 7½ Minute
Quadrangle Maps. The surface area to be disturbed by the amendment is owned by ACIN,
LLC., Daryl Boggs, and Jo Ann Matthews. The
operation will use the contour and auger method
of surface mining.

The amendment application has been filed for
public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, Hazard, Kentucky 41702.
Written comments, objections, or requests for a
permit conference must be filed with the Director,
Division of Permits, 300 Sower Blvd., Frankfort,
Kentucky 40601.

Sunday. No blasting will be performed between
sunset and sunrise unless a blast that has been
prepared during the day must be delayed due
to the occurrence of an unavoidable hazardous
condition and cannot be delayed until the next day
because a potential safety hazard could result that
cannot be adequately mitigated

Entry to the blasting area will be controlled by
signs and barriers. Before each blast is detonated,
audible warnings from a siren will be given. Ten
(10) minutes prior to detonation, access to the
blast area will be controlled by company personnel. Five (5) minutes prior to detonation, three (3)
long soundings of a siren will be given. One (1)
minute prior to detonation, two (2) additional long
soundings from a siren will be given. Immediately
prior to detonation, one (1) additional long blast
will be sounded. No unauthorized person will
be allowed in the blast area until it is thoroughly
checked. If safe, an all-clear signal of a series of
short blasts on the siren will be sounded. Events
which could lead to blasting at times other than
scheduled include but are not limited to rain, lightning or other atmospheric conditions which involve
personnel, operation or public safety. If conditions
occur that require blasting at times other than the
normally scheduled blasting hours, the audible
signals described above will be used to warn the
public of the blasting activity.

BLASTING SCHEDULE

APPLICATION NO. 867-0498

In accordance with the provisions of 405 KAR
16:120, Section 3, A&G Coal Corporation, 302 S.
Jefferson Street, Roanoke, VA 24011, phone no.
(540) 776-7890, proposes the following schedule:

The blasting area consists of approximately
689.85 acres and the blasting site is located approximately 3 miles southeast of Partridge and 3
miles southeast of the intersection of US 119 and
Lewis Creek Road. The operation is located on
the Appalachia and Benham U.S.G.S. 7½ minute
quadrangle map at Latitude 36 degrees, 59 minutes and 50 seconds and Longitude 82 degrees,
49 minutes and 46 seconds.

Blasting will begin on or about July 2021 and
continue through July 2022. All blasting is to be

NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby
given that Sapphire Coal Company, 1073 Riverview Street, Grundy, VA 24614 has applied for
Phase III Bond Release on Increment No.13 of
Permit Number 867-0493, which was last issued
on May 5, 2021. Increment No. 13 cover an area
of 6.73 and located 0.6 miles northeast of Colson
in Letcher County.

The permit is approximately 0.06-mile northeast
of the junction of KY route 7 and KY Route 1410
located 0.05 miles east of Buck Creek. The latitude
is 37o 13’ 37”. The longitude is 82o 50’ 23”.

The bond now in effect for Increment No. 13 of
Permit Number 867-0493 is a Surety Bond in the
amount of nineteen thousand four hundred dollars
($19,400.00). The remaining bond amount of nineteen thousand four hundred dollars ($19,400.00)
is included in the application for release.

Reclamation work performed on Increment No.
13 includes: backfilling, final grading and seeding
completed in the December 2013.

Written comments, objections, and requests for
a public hearing or informal conference must be
filed with the Director, Division of Field Services,
300 Sower Blvd. 2nd Floor, Frankfort, Kentucky
40601, by September 10, 2021.

A public hearing on the application has been
scheduled for September 15, 2021 at 10:00 at
the Department for Natural Resource’s Pikeville
Regional Office located at 121 Mays Branch Road,
Pikeville, Kentucky 41501. The hearing will be
canceled if no request for a hearing or informal
conference is received by September 10, 2021.
