highest bidder at public
auction, the following

The purchaser or successful bidder can elect
to pay cash at the time
of said sale or at the

the terms of a deposit

days. If the purchase
price is not paid in full,
the successful bidder
shall execute a bond
at the time of sale with
sufficient surety approved by the Master
Commissioner prior to
the sale to secure the
unpaid balance of the

purchase price. The
bond shall bear interest
at the rate of twelve
percent (12%) interest
per annum from the
date of sale until paid.
The sale shall be subject to the right of redemption as outlined
in KRS 426.530.
The real property shall

e. Any applicable zoning regulations.

The indebtedness involved in this action
is $12,409.69 as of
June 28, 2021 which
constitutes principal in the amount of
$1,240.82 pursuant
to KRS 134.452(1);
interest in the amount
of $1,930.32, which
constitutes accrual
at 12%, twelve percent, per annum, with
the monthly interest
accruing at a rate of
$12.41 per month until
paid pursuant to KRS
134.452(2); its reasonable attorneys’ fees;
costs in the amount of
$1,771.23; administrative

fees in the amount
of $115.00 pursuant
to KRS 134.452(4) for

1. A minimum of five
(5’) feet shall be maintained between any

must be located behind the front line of
the house on lot (i.e.
to the sides or behind

3. All lots shall be used

4. Trash, rubbish, junk
cards, used trailers,
used appliances, and
other waste shall not
be allowed to accumulate on lot.
5. No advertising signs
shall be displayed on

6. The house shall be
the principle residence
of the owner.
7. Grass and shrubbery
shall be neatly trimmed
at all times. In winter,
snow and ice shall be
kept removed from
walkways and steps.
8. The property shall
remain as housing for
low income families
(not to exceed 80%
of the county median
income) for a period of
40 years or length of
mortgage, whichever is
greater, from the date
of the original deed.
9. HOMES, Inc. shall
be given the first opportunity to purchase
property should owner
liquidate the property
for any reason for a
period of 40 years from
the date of the original
deed in order that the
property remain for low
income housing.
Being the same property conveyed to Danny
Ray Caudill, III and
Charity Ann Caudill,
husband and wife, by
deed dated December 21, 2001, and of

immediately verifiable
and collectible medium
of exchange acceptable to the Master
Commissioner, with
the balance on credit
for thirty (30) days.
If the purchase price
is not paid in full, the
successful bidder shall
execute a bond at the
time of sale with sufficient surety approved
by the Master Commissioner prior to the sale
to secure the unpaid
balance of the purchase price. The bond
shall bear interest at
the rate of twelve percent (12%) interest per
annum from the date
of sale until paid and
said bond shall have
the same force and
effect as a judgment
and shall remain and
be a lien on the subject
property until the purchase price therefore
is fully paid.
The successful bidder at said sale shall,
at such bidder’s own
expense, carry fire and
extended insurance
coverage on said improvements from the
date of sale until the
purchase price is fully
paid, in the amount of
the Court appraised
value of said improvements or the amount
of the unpaid balance
of the purchase price,
whichever is less, at a
minimum, with a loss
payable clause to the
Master Commissioner
of the Letcher Circuit
Court and Plaintiff. Failure of the purchaser to
obtain such insurance
shall not affect the
validity of the sale or
the purchaser’s liability
thereunder, but shall
entitle, but not require,
Plaintiff to obtain said
insurance and furnish
the policy or premium
thereon and the proper
portion thereof shall
be charged to the purchaser as purchaser’s
costs.
The purchaser shall
be required to assume
and pay all taxes or
assessments upon the
subject property for the
current tax year and all
subsequent years.
The subject property
shall otherwise be
sold free and clear
of any right, title or
interest of all parties
to the action and all
liens and encumbrances thereon, excepting easements and

Action Council is now
accepting applications
for bulk fuels for the
SUBSIDY and CRISIS component of
the 2021-2022 Low
Income Home Energy
Assistance Program
( LIHEAP). Vendors
will provide fuel at the
price they have established, not to exceed
the fair market price as
established by LKLP,
and understand that
the customer will select the vendor from
the Approved Vendor
List. The SUBSIDY
component will begin
on November 1, 2021
and continue through
December 10, 2021.
The Crisis component
will begin on January
10, 2022, and continue through March
31, 2022, or until program funds have been
expended. To obtain
