The purchaser or successful bidder can
elect to pay cash at
the time of said sale or
at the option of the bidder on the terms of a
deposit of ten percent
(10%) of the purchase
price to be paid at the
time of the sale with
the balance on credit
for thirty (30) days.
If the purchase price
is not paid in full, the
successful bidder shall
execute a bond at the
time of sale with sufficient surety approved
by the Master Commissioner to secure
the unpaid balance of
the purchase price.
The bond shall bear
interest at the rate of
3.87500% per annum
from the date of sale
until paid.
Any purchaser, other
than the Plaintiff, who
does not pay cash in
full, shall be required
to execute a bond,
with surety thereon acceptable to the Master
Commissioner at least
by noon, two (2) business days before the
sale date, to secure
the unpaid balance of
the purchase price, the
balance on a credit or
said bond shall bear
interest at the rate the
Judgment bears per
annum from the date
of sale until paid and
shall have the same
force and effect as a
judgment and shall
remain and be a lien on
the property until paid.
The successful
bidder(s) at the sale,

at bidder’s own expense, may carry fire
and extended insurance coverage on the
improvements from
the date of sale until
the purchase price is
fully paid, in an amount
at least sufficient to
cover a loss to the
extent of the courtappraised value of the
improvements on the
Real Property or the
unpaid balance of the
purchase price, whichever is less, with the
loss payable clause
to the Master Commissioner. Failure of
the purchase to effect
such insurance coverage shall not affect the
validity of the sale or
the purchaser’s liability
thereunder but shall
entitle but not require
any party adjudicated
an interest in the Real
Property, after giving
notice to the Master
Commissioner, to effect said insurance and
furnish evidence of the
policy to the Master
Commissioner. The
premium on the insurance policy shall then
be charged to the purchaser as purchaser’s
cost.
The purchaser at the
Master Commissioner’s sale shall take the
Real Property free and
clear of the claims of
the parties to this action, properly before
the Court, subject to
the following:
a. All current year ad
valorem real estate
taxes not yet due and
payable and all taxes

b. Easements, restrictions and stipulations
of record affecting the
Real Property.
c. Any assessments for
public improvements
properly levied against

d. Any matters which
would be disclosed by
an accurate survey or

States of America arising under 28 U.S.C.
Sec. 2410.
f. Any right of redemption that may exist in
favor of the Defendants. The indebtedness involved in this action

“Commission”) will conduct a public hearing beginning at 9:00 a.m. Eastern Daylight Savings Time
on Tuesday, October 5,

Hearing Room (Hearing
Room 1) at its offices at

Frankfort, Kentucky
40601. The hearing is for
the purposes of discussing American Electric
Power Company’s strategic review of Kentucky
assets; ownership of the
Mitchell Generating Station; transmission planning and operation, and
other related matters as
part of Case No. 2021-
00370 initiated by the
