NOTICE OF INTENT TO MINE

Pursuant to Application Number 867-5365 Transfer

In accordance with 405 KAR 8:010, notice is hereby given that Blackjewel L.L.C.; 1051 Main Street; Milton, WV 25541 intends to transfer permit number 867-5363 to Mark Energy, LLC; P.O. Box 283; Whitesburg, Kentucky 41858. The new permit number will be 867-5365. The operation disturbs 109.61 surface acres and underlies 5,118.43 acres. No new acreage is affected by the transfer.

The operation is located 1.85 miles southeast of Eolia in Letcher County. The operation is approximately 2.79 miles southeast from US119 junction with KY806 and located 0.38 miles south of Franks Creek. The operation is located on the Whitesburg & Flat Gap U.S.G.S. 7½ Minute Quadrangle Maps at latitude 370 01’ 10”, and longitude 820 47’ 30”.

The application has been filed for public inspection at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, Hazard, Kentucky 41702. Written comments or objections must be filed with the Director, Division of Permits, 300 Sower Blvd., Frankfort, Kentucky 40601. All comments or objections must be received within fifteen (15) days of today’s date.

NOTICE OF INTENTION TO MINE

Pursuant to Application Number 867-0498, Amendment 2

In accordance with the provisions to KRS 350.070, notice is hereby given that A & G Coal Corporation, P O Box 2178, Beaver, WV 25813 has applied for an amendment to an existing surface coal mining and reclamation operation located 0.5 miles north of Partridge in Letcher County. The amendment will add 47.40 acres of surface disturbance and will delete 559.76 acres of shadow area for a total of 463.56 acres within the amended permit boundary.

The permit area is 3 miles southeast of the junction of Lewis Creek Rd. and Route 119. The permit area is in Lewis and Colliers Cr.

The proposed operation is located on the Appalachia U.S.G.S. 7 1/2 minute quadrangle map. The surface area to be disturbed by is owned by NRP, LLC. The operation will use the (contour, auger, area or combination) method of surface mining.

The application has been filed for public inspection at the Department for Natural Resources, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro, Kentucky 40965.

Written comments, objections, or requests for a permit conference must be filed with the Director, Division of Mine Permits, 300 Sower Blvd 2nd Floor, Frankfort, KY 40601.
