NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Sapphire Coal Company, 1073 Riverview Street, Grundy, Virginia 24614 has applied for Phase III on Increment No. 1 of Permit Number 867-5313, which was last issued on October 18, 2018. Increment No. 1 covers an area of approximately 8.61 acres and located 1.25 miles east of Premium in Letcher County.

The permit is approximately 1.90 miles east from KY 588’s junction with KY 160 and located on the North Fork of the Kentucky River. The latitude is 37° 07’ 37”. The longitude is 82° 53’ 36”.

The bond now in effect for Increment No. 1 of Permit Number 867-5313 is a Surety Bond in the amount of eleven thousand nine hundred dollars ($11,900.00). The remaining amount of eleven thousand nine hundred dollars ($11,900.00) is being requested for release.

Reclamation work performed on Increment No. 1 includes: backfilling, final grading and seeding completed in January 2017.

Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Blvd., 2nd Floor, Frankfort, Kentucky 40601 by November 8, 2019.

A public hearing on the application has been scheduled for November13, 2019 at 10:00 at the Department for Natural Resource’s Hazard Regional Office located at 556 Village Lane, Hazard, Kentucky 41702. The hearing will be canceled if no request for a hearing or informal conference is received by November 8, 2019.

NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Blue Diamond Mining, LLC, 3228 Summit Square Place, Suite 180, Lexington, Kentucky 40509 has applied for Phase I bond release on Increments 1 and 2 of permit number 867-0526 which was last issued on July 21, 2017. Increment 1 covers an area of approximately 30.50 acres and Increment 2 covers an area of approximately 26.90 acres located 1.4 miles northwest of Carcassonne and is situated in both Letcher County and Perry County, Kentucky.

The permit area is approximately 2.6 miles northeast from Bull Creek Road’s junction with Upper Lick Fork Road and located 0.58 miles south of Montgomery Creek.

The bond now in effect for Increment 1 is a surety bond in the amount of $125,300. Sixty percent (60%) of the original bond amount of $125,300 is included in the application for release.

The bond now in effect for Increment 2 is a surety bond in the amount of $122,300. Sixty percent (60%) of the original bond amount of $122,300 is included in the application for release.

Reclamation work performed for Increments 1 and 2: backfilling, grading and seeding which was completed prior to Fall 2015. Results thus far achieved are backfilling, grading, and initial revegetation of disturbed areas.

Written comments, objections, and request for a public hearing or informal conference must be filed with the Director, Division of Mine Reclamation and Enforcement, 300 Sower Boulevard, Frankfort, Kentucky 40601 by November 22, 2019.

A public hearing has been scheduled for Wednesday, November 27, 2019 at 10:00 a.m. at the Division of Mine Reclamation and Enforcement’s Hazard Regional Office, P.O. Box 851, Hazard, Kentucky 41702. The hearing will be cancelled if no request for a hearing or informal conference is received by November 22, 2019.
