COMMISSIONER

SALE By virtue of a Judgment and Order of Sale and Order Referring Case to Master Commissioner for Judicial Sale entered by the Letcher Circuit Court on the 13th day of September 2019, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Tuesday, October 29, 2019 beginning on or about the hour of 11:00 a.m., local time and continuing until the sale is concluded to the highest bidder at public auction, the following described real property lying in Letcher County, Kentucky: Property Address: 1421 Highway 3406 Mayking, KY 41837 Parcel No.: 051-00-00- 125.01 The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of a deposit of 10% of the purchase price with the balance on credit for 30 days. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety approved by the Master Commissioner to secure the unpaid balance of the purchase price. The bond shall bear interest at the rate of 3.875% per annum from date of sale until paid and shall have the full force and effect of a judgment and said bond shall constitute a lien on said property until paid. The purchaser shall take the real property free and clear of the claims of the parties to this action and all liens and/or interests arising by virtue of instruments which are recorded in the Letcher County Clerk’s Office or otherwise arise, after the recording of the Plaintiff’s Lis Pendens notice, but it shall be sold subject to the following, for which the Purchaser shall not have a credit against the purchase price: a. All state, county, and city real estate taxes not yet due and owing at the time of sale; b. Easements, restrictions and stipulations of record; c. Assessments for public improvements levied against the real property. d. Any facts which an inspection and accurate survey of the real property may disclose. The purchaser shall be responsible for the real estate taxes for the current year of sale and thereafter. It is further provided that the real property sold includes insurable improvements and the successful bidder at said sale shall, at bidder’s expense, carry fire and extended insurance coverage on said improvements from the date of the sale until the purchase price is fully paid, to the extent of the Court appraised value of said improvements or the unpaid balance of the purchase price, whichever is less, as a minimum, with a loss payable clause to the Commissioner of the Letcher Circuit Court or the Plaintiff herein. Failure of the purchaser to effect such insurance shall not affect the validity of the sale or the Purchaser’s liability thereunder but shall entitle but not require the Plaintiff to effect said insurance and furnish the policy and the premium thereof or the proper portion thereof shall be charged to the Purchaser as Purchaser’s costs. The indebtedness involved in this action is $145,180.46 plus interest at the current rate of 3.875% ($13.98 per diem) from November 1, 2018 until paid plus advances for taxes and insurance premiums and its costs expended herein, including a reasonable attorney fee and for any other fees expended for services performed in connection with the Defendants’ default and for protecting Plaintiff’s interest in the real property and its rights under the mortgage instrument; the cost of this action and its costs herein expended, including the cost of the sale.
