In accordance with KRS 350.093, notice is hereby given that Hardshell Tipples, Inc., 40 West Main St., Whitesburg, Kentucky 41858 has applied for a Phase I bond release on Increment No. 2 on Permit Number 867-5188 which was last issued on July 30, 2019. The proposed operation is located on the Mayking U.S.G.S. 7 ½ minute quadrangle map. The operation will use the refuse recovery method of surface mining. The surface area is owned by Ralph Johnson and Ellis Duncil.

NOTICE OF BOND RELEASE

Pursuant to Permit Number 848-0206

In accordance with KRS 350.093, notice is hereby given that Nally & Hamilton Enterprises, Inc., P.O. Box 157, Bardstown, Kentucky 40004 has applied for a phase II and III bond release on increments 8 and 11 of permit no. 848-0206 and a phase III bond release on increment 9 which was last issued January 26, 2015. Increment no. 8 covers an area of approximately 14.2 acres of surface area. Increment no. 9 covers an area of approximately 9.19 acres of surface area. Increment no. 11 covers an area of approximately 133.11 acres of surface area.

The permit area is located approximately 0.88 miles Southwest from Lewis Creek Road’s junction with U.S. 119 and located in Coldiron Branch, Lewis Creek and Wilson Fork. The permit area is also located approximately 1.00 mile south of Partridge in Harlan and Letcher Counties.

The bond now in effect for Increment no. 8 is a surety bond in the amount of $5,000.00 of which 100% of the original total bond amount of $33,700.00 is to be included in this application for release. The bond now in effect for Increment no. 9 is a surety bond in the amount of $3,900.00 of which 100% of the original total bond amount of $24,400.00 is to be included in this application for release. The bond now in effect for Increment no. 11 is a surety bond in the amount of $97,900.00 of which 100 % of the original total bond amount of $133,100.00 is to be included in this application for release.

Reclamation work performed included: All mining area was backfilled and graded with all highwalls eliminated and the area was seeded, this work was completed in spring of 2011.

Written comments, objection and request for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Boulevard Frankfort, Kentucky 40601 by Friday January 17, 2020.

A public hearing on the application has been scheduled for Tuesday, January 21, 2020 at 9:00 a.m., at the Department for Natural Resources, Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro Kentucky 40965-1229.
