NOTICE OF INTENTION TO MINE

Pursuant to Application No. 867-0556 NW

In accordance with the provisions of KRS 350.055,
notice is hereby given that Nally & Hamilton Enterprises, Inc., P.O. Box 157; Bardstown, Kentucky
40004 (Phone: 502-348-0084), has applied for a
permit for a surface coal mining and reclamation
operation affecting 266.22 acres of surface and
120.40 acres of auger/highwall mining for a total
of 266.22 acres located 2.2 miles northwest of
Gordon in Letcher County, KY.

The proposed operation is approximately 0.9 miles
north from Ky. 463 junction with Defeated Creek
Road and located in Road Fork of Trace Branch
and Defeated Creek.

The proposed operation is located on the Tilford
U.S.G.S. 7.5 minute quadrangle map. The operation will use the Contour and Auger/Highwall
Mining method of re-mining. The surface area is
owned by Kentucky River Properties.

The application has been filed for public inspection
at the Department fort Surface Mining, Reclamation and Enforcement’s Hazard Regional Office,
556 Village Lane, P.O. Box 851, Hazard, KY
41702. Written comments, objections, or requests
for a permit conference must be filed with the Director, Division of Permits, 300 Sower Boulevard,
Frankfort, Kentucky 40601.
