In accordance with the provisions of 405 KAR 16:120, Section 3, A&G Coal Corporation, 302 S. Jefferson Street, Roanoke, VA 24011, phone no. (540) 776-7890, proposes the following schedule:
The blasting area consists of approximately 689.85 acres and the blasting site is located approximately 3 miles southeast of Partridge and 3 miles southeast of the intersection of US 119 and Lewis Creek Road. The operation is located on the Appalachia and Benham U.S.G.S. 7½ minute quadrangle map at Latitude 36 degrees, 59 minutes and 50 seconds and Longitude 82 degrees, 49 minutes and 46 seconds.
Blasting will begin on or about July 2020 and continue through July 2021. All blasting is to be conducted during daylight hours Monday through Sunday. No blasting will be performed between sunset and sunrise unless a blast that has been prepared during the day must be delayed due to the occurrence of an unavoidable hazardous condition and cannot be delayed until the next day because a potential safety hazard could result that cannot be adequately mitigated
Entry to the blasting area will be controlled by signs and barriers. Before each blast is detonated, audible warnings from a siren will be given. Ten (10) minutes prior to detonation, access to the blast area will be controlled by company personnel. Five (5) minutes prior to detonation, three (3) long soundings of a siren will be given. One (1) minute prior to detonation, two (2) additional long soundings from a siren will be given. Immediately prior to detonation, one (1) additional long blast will be sounded. No unauthorized person will be allowed in the blast area until it is thoroughly checked. If safe, an all-clear signal of a series of short blasts on the siren will be sounded. Events which could lead to blasting at times other than scheduled include but are not limited to rain, lightning or other atmospheric conditions which involve personnel, operation or public safety. If conditions occur that require blasting at times other than the normally scheduled blasting hours, the audible signals described above will be used to warn the public of the blasting activity.
NOTICE OF INTENTION

Major Revision No. 9
In accordance with KRS 350.070, notice is hereby given that Sapphire Coal Company, 1073 Riverview Street, Grundy Virginia 24614 has applied for a major revision to an existing underground coal mining and reclamation operation located 0.42 miles west of Polly in Letcher County. The major revision will not add any surface disturbance acreage or underground acreage to the permit area.
The proposed major revision area is approximately 0.42 miles west from KY Route 931’s junction with KY Route 1862 and located 0.5 miles south of Camp Branch. The Latitude is 37° 12’ 10”. The Longitude is 82° 49’ 45”.
The proposed major revision is located on the Mayking U.S.G.S. 7-1/2 minute quadrangle map. The surface area to be affected by the major revision is owned by Sapphire Coal Company and Kentucky River Properties, LLC.
The major revision proposes to change the post mining land use from forestland to light industrial/ commercial for a portion of the permit.
The major revision application has been filed for public inspection at the Department of Natural Resources, Division of Mine Reclamation and Enforcement’s Pikeville Regional Office, 121 Mays Branch Road, Pikeville, Kentucky 41501. Written comments, objections, or requests for a permit conference must be filed with the Director, Division of Mine Permits, 300 Sower Blvd., Frankfort, Kentucky 40601.
NOTICE OF BOND RELEASE
Pursuant to Application Number 897-0376
In accordance with KRS 350.093, notice is hereby given that Nally & Hamilton Enterprises, Inc., P.O. Box 157, Bardstown, Kentucky 40004 has applied for a phase II and III bond release on increment no 3 and a phase III bond release on increment no.’s 4 and 6 of permit No 897-0376 which was last issued September 1, 2011. Increment 3 covers an area of approximately 95.7 acres of surface area. Increment 4 covers an area of approximately 95.93 acres of surface area. Increment 6 covers an area of approximately 446.62 acres of surface area.
The permit area is approximately 2.6 miles east from KY 699’s junction with Kentucky 221 at Big Laurel and located 2.70 miles southwest of Leatherwood and located in Harlan, Perry & Letcher Counties.
The bond now in effect for increment no. 3 is a surety bond in the amount of $91,900.00 of which 100% of the original amount of $91,900.00 is to be included in this application for release. The bond now in effect for increment no.4 is a surety bond in the amount of $104,700.00 of which 100% of the original amount of $251,300.00 is to be included in this application for release. The bond now in effect for increment no.6 is a surety bond and a cash bond in the amount of $204,700.00 of which 100% of the original amount of $1,392,700.00 is to be included in this application for release.
Reclamation work performed included: All mining area was backfilled and graded with all highwalls eliminated and the area was seeded, this work was completed in the Spring of 2002.
Written comments, objection and request for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Blvd., Frankfort, Kentucky 40601 by Monday, September 21, 2020.
A public hearing on the application has been scheduled for Wednesday September 23, 2020 at 10:00 AM, at the Department for Natural Resources, Hazard Regional Office, 556 Village Lane, Hazard Kentucky 41702. This hearing will be canceled if no request for a hearing or informal conference is received by Monday, September 21, 2020.
