COMMISSIONER
SALE

By virtue of an Order to Reschedule Master Commissioner Sale entered on December 12, 2019 and Order Referring Case to Master Commissioner for Judicial Sale entered by the Letcher Circuit Court on the 25th day of September, 2020, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Monday, October 26, 2020, beginning on or about the hour of 1:30 p.m., local time and continuing until the sale is concluded to the highest bidder at public auction, the following described real property, lying in Letcher County, Kentucky: Location: Blackey, Kentucky Map ID No.: 043-60- 00-024.00 The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of 10% of the purchase price at the time of the sale with the balance to be paid within 60 days and any purchaser shall be required to execute bond with surety thereon to be approved by the Master Commissioner to secure the unpaid portion of the purchase price, with the bond to bear interest at the rate of 12% per annum from date of sale until paid and the bond shall have the same force and effect as a judgment and shall remain and be a lien on the real property until fully paid. Said property shall be sold subject to such right of redemption s may exist in favor of the Defendant pursuant to KRS 426.220. The purchaser shall be required to pay the ad valorem taxes for 2017 and all subsequent years and shall take said real property subject to all restrictive covenants and easements of record in the Letcher County Court Clerk’s Office. The risk of the loss on improvements on the real property passes to the purchaser at the time of delivery of the Master Commissioner’s deed to said purchaser. The indebtedness involved in this action is $6,011.95 for tax bills 2011, 2012, 2013 and 2014 including accrued interest, administrative fees, attorney’s fees and court costs; the cost of this action and its costs herein expended, including the cost of the sale. By virtue of a Summary Judgment and Default Judgment To Set Lien Priorities, Summary Judgment and Order of Sale, Default Judgment to Release Lien and Order Referring Case to Master Commissioner for Judicial Sale entered on October 5, 2020, by the Letcher Circuit Court, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Monday, November 2, 2020, beginning on or about the hour of 11:00 a.m. local time and continuing until the sale is concluded to the highest bidder at public auction, the following real estate, situated in Letcher County, Kentucky: Being House #2015, Lot No. 7, Block No. 2, located on Band Mill Bottom Section of McRoberts, containing 0.09 acres, more or less, as designated and described on Jenkins Subdivision Map No. 11, recorded in Plat Book No. 1, at Page 114-115, et seq., of the Letcher County Clerk’s Office, to which reference is made for better description. Being the same property conveyed to Deborah W. Sergent and William M. Sergent, her husband, to Jason R. Holbrook, single, by deed dated April 22, 2010, and recorded in Deed Book 405, Page 724, records of the Letcher County Court Clerk’s Office. The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of a deposit of ten percent (10%) of the purchase price with the balance on credit for thirty (30) days. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety to secure the unpaid balance of the purchase price and said bond shall constitute a lien on the said property until paid. The bond shall bear interest at the rate of 12% per annum from the date of sale until paid. The costs involved in this action are $8,148.05 as of July 31, 2020, plus interest at the rate of 8.75% per annum from the date of judgment and thereafter as the maximum judgment rate plus attorney fees and court costs to be determined by later proceedings; the cost of this action and its costs herein expended, including the cost of the sale.
