COMMISSIONER
SALE

By virtue of a Summary Judgment and Default Judgment To Set Lien Priorities, Summary Judgment and Order of Sale, Default Judgment to Release Lien and Order Referring Case to Master Commissioner for Judicial Sale entered on October 5, 2020, by the Letcher Circuit Court, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Monday, November 2, 2020, beginning on or about the hour of 11:00 a.m. local time and continuing until the sale is concluded to the highest bidder at public auction, the following real estate, situated in Letcher County, Kentucky: Being House #2015, Lot No. 7, Block No. 2, located on Band Mill Bottom Section of McRoberts, containing 0.09 acres, more or less, as designated and described on Jenkins Subdivision Map No. 11, recorded in Plat Book No. 1, at Page 114-115, et seq., of the Letcher County Clerk’s Office, to which reference is made for better description. Being the same property conveyed to Deborah W. Sergent and William M. Sergent, her husband, to Jason R. Holbrook, single, by deed dated April 22, 2010, and recorded in Deed Book 405, Page 724, records of the Letcher County Court Clerk’s Office. The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of a deposit of ten percent (10%) of the purchase price with the balance on credit for thirty (30) days. If the purchase price is not paid in full, the successful bidder shall execute a bond at the time of sale with sufficient surety to secure the unpaid balance of the purchase price and said bond shall constitute a lien on the said property until paid. The bond shall bear interest at the rate of 12% per annum from the date of sale until paid. The costs involved in this action are $8,148.05 as of July 31, 2020, plus interest at the rate of 8.75% per annum from the date of judgment and thereafter as the maximum judgment rate plus attorney fees and court costs to be determined by later proceedings; the cost of this action and its costs herein expended, including the cost of the sale. By virtue of an In Rem Summary, Default Judgment and Order of Sale and Order Referring Case to Master Commissioner for Judicial Sale entered on September 21, 2020, by the Letcher Circuit Court, the undersigned Master Commissioner of the Letcher Circuit Court will offer for sale at the courthouse door of the Letcher County Courthouse in the City of Whitesburg, Kentucky on Monday, November 9, 2020, beginning on or about the hour of 11:00 a.m. local time and continuing until the sale is concluded to the highest bidder at public auction, the following real estate, together with all improvements on the real estate, including the principal place of residence and appurtenances related to it, situated in Letcher County, Kentucky: Property Address: 176 Crown Hill Road Jenkins, Kentucky 41537 Kentucky Map ID: 053- 70-22-129.00 The purchaser or successful bidder can elect to pay cash at the time of said sale or at the option of the bidder on the terms of a deposit of ten percent (10%) of the purchase price with the balance payable within thirty (30) days. The purchaser shall be required to execute a bond with surety thereon to secure the unpaid balance of the purchase price. Said bond shall bear interest at the rate of 12% per annum from the date of sale until paid and shall have the same force and effect as a Judgment and shall remain and be a lien on the property until paid. The purchaser shall take the real estate free and clear of the claims of the parties to this action but it shall be sold subject to the following, for which the purchaser shall take no credit against the purchase price: a. Easements, restrictions and stipulations of record. b. Any matters which would be disclosed by an accurate survey or inspection of the property. c. Any current assessments for public improvements levied against the property. The purchaser shall assume the ad valorem taxes which become due and payable after the sale date. The costs involved in this action as of 8/ 10/ 2020 are $4,194.98 plus interest at 12% on the actual purchase price of the certificate of delinquency; the cost of this action and its costs herein expended, including the cost of the sale.
