NOTICE OF INTENTION TO MINE

Pursuant to Application Number 867-7040

In accordance with KRS 350.055, notice is hereby given that Coking Coal, LLC, PO Box 16, Norton, VA 24273, has applied for a permit for a surface coal mining and reclamation operation affecting 56.5 acres located 1.92 miles southwest of Eolia in Letcher County.

The proposed operation is approximately 2.10 miles southeast from US 119’s junction with KY 806 and located on Franks Creek. The latitude is 37°01’38”. The longitude is 82°48’17”.

The operation is located on the Whitesburg U.S.G.S. 7 1/2 minute quadrangle map. The operation will be a “Haul Road Only” permit. The surface area is owned by ACIN, LLC.

The application has been filed for public inspection at the Department of Surface Mining Reclamation and Enforcement’s Hazard Regional Office, 556 Village Lane, Hazard, KY 41702. Written comments, objections, or requests for a permit conference must be filed with the Director, Division of Permits, 300 Sower Blvd., Frankfort, Kentucky 40601.

NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby given that Sapphire Coal Company, 1073 Riverview Street, Grundy, Virginia 24614 has applied for Phase I and II Bond Release on Increment No. 2 of Permit Number 867-8058, which was last issued on May 28, 2019. Increment No. 2 covers an area of approximately 4.59 acres located 1.0 mile north of Polly in Letcher County.

The permit is approximately 0.1 mile northeast from KY 931’s junction with KY 1862 and located 0.1 mile east of Camp Branch. The latitude is 37o 12’ 11”.The longitude is 82o 49’ 26”.

The bond now in effect for Increment No. 2 of Permit Number 867-8058 is a Surety Bond in the amount of fifty thousand dollars ($50,000.00), which eighty-five (85%) of the bond at fifty thousand dollars ($50,000.00), is being requested for release.

Reclamation work performed on Increment No. 2 includes: backfilling, final grading, seeding and trees planted completed in Spring 2015.

Written comments, objections, and requests for a public hearing or informal conference must be filed with the Director, Division of Field Services, 300 Sower Blvd., 2nd Floor, Frankfort, Kentucky 40601, by January 29, 2021.

A public hearing on the application has been scheduled for February 3, 2021 at 10:00 a.m. at the Department for Natural Resource’s Hazard Regional Office located at 556 Village Lane, Hazard, Kentucky 41702. The hearing will be canceled if no request for a hearing or informal conference is received by January 29, 2021.
