sale is concluded to the
highest bidder at public auction, the following

The Court finds that the
subject real estate is indivisible and cannot be
divided without materially
impairing its value and
the value of Plaintiff’s lien
thereon and shall be sold
as a whole.
The purchaser or successful bidder can elect
to pay cash at the time of
said sale or at the option
of the bidder on the terms
of a deposit of 10% of
the purchase price with
the balance on credit for
30 days. If the purchase
price is not paid in full,
the successful bidder
shall execute a bond at
the time of sale with sufficient surety approved by
the master commissioner
prior to the sale to secure
the unpaid balance of the

shall bear interest at the
rate of 12% per annum

In accordance with KRS 350.093, notice is
hereby given that Cook and Sons Mining
Inc, 147 Big Blue Boulevard, has applied for
Phase II/III Bond Release on Permit Number
867-0436 that was last issued on September

business hours.

Any citizen may obtain from the Letcher County
Clerk’s ofce a copy of the complete 2014 audit report, including nancial statements and supplemental
information, for their personal use. Any citizen obtaining a personal copy will be charged for duplication
costs at a rate that shall not exceed twenty-ve cents
(0.25) per page.

Copies of the 2014 nancial statement only prepared
in accordance with KRS 424.220 are available to the
public at no cost at the business address of the ofce
of the Letcher County Clerk.

for $2,100. Approximately 40% of the original
bond amount is included in the application for

Reclamation work performed includes: backfilling, grading, seeding, fertilizing, and mulching
that was completed in September of 2006.

Written comments, objections, and requests
for a public hearing or informal conference
must be filed with the Director, Division of Field
Services, 2 Hudson Hollow, Frankfort, Kentucky
40601, by September 16, 2016.

A public hearing on the application has been
scheduled for September 19, 2016, at 10:00
a.m. at the Department for Surface Mining
Reclamation and Enforcement’s Pikeville Regional Office, 121 Mays Branch Road, Pikeville,
KY, 41501. The hearing will be canceled if no
request for a hearing or informal conference is
received by September 16, 2016.
