A Letcher County Grand Jury has indicted Charles Evans Hall, a Letcher County teacher and former consultant with the Kentucky Department of Education, on multiple counts related to a sexual relationship with 14-year-old female student, and child pornography charges.
Hall, 45, of Jackhorn, is charged with unlawful use of an electronic device to engage in sexual or prohibited activities, tampering with a witness, tampering with physical evidence, third-degree rape, first-degree sexual abuse, third-degree sodomy, possession or viewing of matter portraying a sexual performance by a minor, use of a minor in a sexual performance , first-degree sexual abuse and third-degree sodomy.
The indictment was returned January 10 in Letcher Circuit Court.
Hall was a teacher at Letcher County Alternative School and a former assistant football coach at Letcher County Central High School when he was arrested in early December. He had been a teacher at Letcher Middle School when he was suspended last spring pending an investigation, but was reinstated as a teacher at the alternative school after a Kentucky State Police Post 13 investigation of that incident lapsed. Both police and the school district said at the time that the allegations were unsubstantiated.
The indictment accuses Hall of committing the acts during a period from April 1, 2018, to November 29, 2018. The indictment claims Hall “induced or attempted to induce” the girl involved to “absent herself or otherwise avoid appearing or testifying at the official proceedings,” or making false statement, or “practiced fraud or deceit though expressions of purported love for said minor, and through purported threats of his imminent death if said child did not withhold her testimony and/or evidence.”
The indictment also claims Hall “destroyed, mutilated, concealed, removed or altered the electronic and/or other physical evidence which he is believed was about to be produced or such in such official proceeding.”
The rape charge stems from alleged sexual intercourse between Hall and the girl while she was under 16, and the sexual abuse charge involved sexual contact with her while she was under 16, or engaging in masturbation in front of her, either in person or via video or audio communications. The sodomy charge also stems from the age difference between them.
The two charges related to child pornography involve viewing or possessing matter that depicts sexual performance by a minor, and inducing the girl to engage in a sexual performance.
KSP Detective Jason Dials of the KSP E-Crimes Division testified to the grand jury in the case.
The Kentucky Education Professional Standard’s Board still lists Hall’s Rank 1 certification and his credentials as a social studies teacher as good until June 30, 2019.
Hall’s online profiles say he has taught for 23 years, and list him as a social studies teacher/department head. Hall’s profile says he spent 2011-2013 as a social studies consultant at the Kentucky Department of Education.
Kentucky State Police arrested Hall November 30 at a residence at Jackhorn and booked him into the Letcher County Jail at 4:39 p.m. that afternoon. He remained in jail late this Tuesday.
The arrest warrant state police served on Hall says that during the period from April 1 to November 29 of this year, Hall began texting and sending messages via Snapchat to a student “in a graphic manner, with intent to induce her to engage in prohibited sexual activity.”
The warrant further alleges that Hall committed third-degree rape on September 29, “when he had sexual intercourse with (the girl), a 14-year-old minor.” The warrant says Hall “touched her private parts,” and “engaged in deviate sexual intercourse with a 14-year-old minor by engaging in oral sex with said minor.”
According to documents obtained by The Mountain Eagle before Hall’s arrest, the latest incidents were reported to Kentucky State Police about two weeks ago by the mother of the girl, who said her older daughter had seen explicit pictures of sex acts on the Snapchat account on the now 15-yearold’s cell phone. One of the photos included the face of a man the older daughter identified as Hall. The texts purportedly included discussions of past sexual acts. Police say they interviewed both girls and Hall, and seized the teacher’s cell phone after he refused to give them the pass code, or let them see the contents of his Snapchat account.
Police obtained search warrants to open and search the memories of two cell phones, and to obtain information from Snapchat.
According to search warrants, the girl told police that she and Hall had sexual intercourse during the 2018 Mountain Heritage Festival in the teacher’s car while it was parked in the woods. The girl told police there had been earlier allegations that she denied at the time, and after the investigation was dropped she and Hall resumed their relationship using Snapchat. The teacher has been accused of sex offenses against students in the past but allegations were never proved. Charges were expunged from his court record at least once. This is the first time that court documents have surfaced alleging that photographic evidence of a liaison exists.
